Petition to United States President and all State Governors: Grant Consumer Rights to Choose E-cigarette and Vaping Products; Immediately Reverse All Bans Violating our Rights. STOP POLITICIANS FROM DICTATING CHOICES OF ADULTS WHO VAPE.

We stand against willful dangerous acts instituted by politicians in the United States who seek to ban e-cigarette products. We hereby request our rights to be respected and honored by ALL states and lawmakers, and the United States President, Donald Trump.

UNDER THE CONSUMER BILL OF RIGHTS AND AS AMERICAN CITIZENS, WE HEREBY EXERCISE:

OUR RIGHT TO CHOOSE FREELY

Consumers should have a variety of options provided by different companies from which to choose to buy products. The federal government has taken many steps to ensure the availability of open competition between companies. This includes protections against businesses or enterprises who seek to monopolize a market.

As Consumers, we expect our right to choose to be respected and granted, without hindrance such as false information and "fake news." False "scares" and "dangers of vaping" are opinion only, and not based on fact. Such scare tactics are meant to control buying choices of Consumers, put small e-cigarette liquid makers and stores out of business, and increase profits for large tobacco or pharmaceutical companies. 

If flavored liquids are banned, thousands of companies will go out of business, leaving nearly no product options to choose from, as everyone would be forced to carry the same flavor. To date, there is no much enjoyed "tobacco flavored" e-liquid.

We as a community wish to continue purchasing the flavored e-cigarette liquids of our choice from reputable e-liquid companies, with absolutely no government agencies infringing upon our right to choose.

The #1 most successful way of quitting is having the right to choose a flavor of liquid that does not resemble tobacco flavors. By the government restricting flavors to only that which replicates cigarettes, many may return to smoking cigarettes. This gives an unfair advantage for big tobacco to benefit from ex smokers who are left with no options other than various types and brands of tobacco cigarettes. Many may also turn to foods containing high sugar content, alcohol, or other drugs to satisfy nicotine cravings. Big tobacco will have an unfair advantage by potentially gaining back smokers. Juul will dominate the market for vaping, pushing smaller competitors out of business. This will be provoked by Governors who have overstepped their bounds and forced consumers to buy what the Governor prefers in flavor choice. 

OUR RIGHT TO BE HEARD

If Consumers take issue with a product or service, we have a right to be heard. As a large community of Consumers who use electronic cigarettes, we fully support the use of flavored e-cigarette liquids. We fully object to politicians, for-profits, non-profits, and government organizations restricting our right to be heard. 

OUR RIGHT TO REDRESS

The right to redress provides for consumers to receive a fair settlement of just claims, including compensation for misrepresentation, shoddy goods, or unsatisfactory services. Upon information and belief, politicians and media have knowingly and intentionally made false or inaccurate statements and misrepresentations regarding alleged "dangers" of standard e-cigarette vaping. Thus far, no proof or medical evidence has been shown that flavored e-cigarette liquid or vaping devices have caused any illness. Lawmakers have no rights over any adult who is old enough to vape, to enforce what flavor they must purchase for their personal use. The basis by which lawmakers imply they have such a right, is false information, assumptions, and opinions which seek to create undue public panic. 

Vaping Ban Propaganda & Fake News

Cuomo

As of September 2019, Governor Cuomo of the state of New York, announced that he is banning flavored electronic cigarette liquids. Cuomo made false statements regarding the use of ecigarettes, stating without factual evidence, that vaping is "dangerous" based on his opinion. 

Trump

President Donald Trump also made false statements regarding alleged "dangers" of vaping, stating Melania's concern for her son. Trump Supporters are shocked that the President would dare to infringe on their right to choose the products they feel will best help them quit smoking; namely fruity and various other flavors meant to draw the mind away from cigarettes and replace it with an enjoyable experience which resembles sipping a juice drink or eating a childhood favorite type of cereal or dessert.

Many who oppose lawmakers getting involved in their personal buying choices are now vowing to flood the polls and vote against Trump if he does not protect Consumers and stand against Governors and lawmakers who are taking away Consumer rights. Melania Trump has also taken slack for her desire to force adults to purchase one flavor only, after using her son to further propaganda. Michigan Governor Gretchen Whitmer also instituted a flavor ban which is also based on false information and scare tactics which may ultimately make the state more money in tobacco sales, if people go back to smoking cigarettes. Michigan voters are now rallying against the law. The Detroit News website states:

"According to a leaked copy of the emergency rules (which are not yet finalized), anyone found with four or more flavored vaping products is "presumed to possess said items with the intent to sell." This is punishable by imprisonment of six months and a fine per item."

Prison sentences for vaping strawberry flavored nicotine, to help one quit or stay away from smoking cigarettes? This must be stopped and overturned immediately. 

The falsely spread information is based on young teens who vaped street drugs and THC-containing products with the intent to get high, utilizing the electronic cigarette devices which are meant to assist adults in quitting smoking. 

NON-PROFITS WHO DEMONIZE VAPING AFTER PROPAGANDA HYPE:

American Lung Association

The ALA makes assertive statements on their website about e-cigs that are opinion based. They knowingly mislead readers to believe general vaping is "dangerous". This is willful and intentional misrepresentation. 

The ALA claims to have helped 89,000 callers who called a hotline and wanted to quit smoking. That is less than 0.5% of the estimated 20,000,000 who use e-cigarettes; many of whom enjoyed the device to quit smoking cigarettes.

FDA

The FDA classified the e-cig as a "tobacco product" though it contains no tobacco. This is intentional misrepresentation by a Federal Agency. FDA admits that "evidence suggests completely switching from cigarettes to e-cigarettes and other noncombustible products may present a significant harm-reduction opportunity to addicted adult smokers." 

The FDA has also proposed to remove nicotine from cigarettes to "minimally addictive or non-addictive levels." There would be nearly no nicotine left in a cigarette if they succeed in this.

The FDA supports the highly outdated Nicotine Replacement Therapies (NRTs) as successful ways to quit, yet they have extremely high failure rates. FDA says NRTs are safe "IF USED PROPERLY". They do not discuss what happens if they are not used properly. Examples of NRT are nicotine patches, lozenges and gum, ALL of which are available to ages 18+. However, lawmakers want to set legal ages to 21 to vape nicotine. There is absolutely no logic in this. 

American Cancer Society

While still suggesting outdated methods, and parroting misleading or even blatantly false information on e-cigarettes, the American Cancer Society has thus far been the only source which offers clear, easy to read full transparency on side effects of other FDA approved Nicotine Replacement Therapies, along with the symptoms of nicotine overdose, using NRTs. However, a recent article by ACA has no mention of the recent illegally vaped drugs or the Vitamin E Acetate which was used by black market suppliers to cut the THC liquids to increase profits. There is no mention of intentional cocaine vaping or any drug tests done to confirm the teens were not vaping nicotine. Most teens eventually admitted they were not vaping nicotine, but rather buying drugs and vaping them.

Nicotine Replacement Therapy Side Effects

*All nicotine therapies can cause side effects. However, the e-cigarette is the only nicotine referred to as "dangerous" based on manipulated data, fake news, manipulation to create panic, and the like.

BANNING MENTHOL: 

The website TruthInitiative.org states that 90% of African Americans smoke menthol cigarettes. "Among white, black, Hispanic and Asian-Americans, black Americans report the most interest in quitting, but have the lowest success rate." Cuomo has expressed his desire to ban menthol flavored ecigs, which may result in most black smokers continuing to smoke cigarettes and pay exhorbitant taxes, if they cannot have access to menthol or fruit flavors they may enjoy.

Over 20% of LGBTQ men and women smoke cigarettes. Over 66% expressed a desire to quit as reported on TruthInitiative website. If the flavors are removed from ecigarettes, most will continue to smoke, and New York will continue make money off of the cigarette tax which has been drastically reduced since vaping became the go-to for smokers.

Did you know?
The NRA is currently suing Cuomo for deliberately infringing on their first amendment rights. They are represented by William Brewer, a partner at Brewer Attorneys & Counselors. Cuomo is now infringing on the Consumer rights of Vapers in New York, while Trump threatens the entire country of adult Vaping consumers. 

We ask lawmakers to respect Consumer Rights to choose and be heard.
