Why this petition matters
Oriana's law will make the difference in an innocent life lost tragically during a police pursuit. The driver of the vehicle has control over operating a vehicle yet not the passenger, which is probably a nice feeling, unless you're an innocent bystander as the driver has committed a crime yet refusing to pull over for an officer in pursuit. A police pursuit is at the officer's discretion after any community safety concerns become a factor such as traffic on the roads, pedestrians and the speed of the vehicles in the chase. The community is at a great loss after the vehicle in pursuit lost control and the two occupants were killed. In the wee hours after Halloween 2019 an officer attempted to make a traffic stop on a truck with two occupants in Kerrville, TX. The driver didn't stop for the officer so a police pursuit began. The vehicle was driven by a man but the was also an innocent bistandard inside the vehicle at that very moment. The truck had a passenger, there was a 14 year old girl in there who had no choice as to where she was going nor the driver's thoughts and actions because she was with her father after celebrating the holiday festivities. As speeds quickly went from 45 mph up to over 100mph the driver continued to evade police and the police continued to attempt a stop of the vehicle. As the vehicle rounded the last corner it would make the driver lost control and the truck shot off the road and into many objects. The end result of the wreck with the driver and innocent child was two fatalities. The young girl leaves behind a mother, brother, family and friends. An entire community is devistated. This loss could have been prevented had the officers in pursuit used their better judgement in this situation. Officer's have the right to use better judgement but often don't which can result in loss of life as well as have several other negative affects. The passenger of the truck was an innocent child who had no choice to pull over and no way to safety exit the vehicle. When an officer notices another occupant in a vehicle than the driver alone, they should be aware that the passenger(s) are more often than not unintentionally involved. Innocent lives should matter to our justice system just as much as catching those who've committed crimes. We want to prevent as many loses as we can and if Oriana's law is put in place it will potentially create a safer community for us all. Police should be regulated as to their duties. For example, if the are occupants in a vehicle and the driver is evading arrest, the innocent lives shouldn't be spared to attempt to stop one crime. The officer involved would have had to make a case so charges could be filed and the driver would have been charged and potentially convicted. This would create safer roads, traffic stops and in turn a safer community. We want to prevent losing our children and our future by being proactive.
