Abolish House Bill 15-1043

It is a Class 4 Felony in Colorado to commit DUI, DUI per se, or DWAI and to have three prior convictions for any of these offenses in one’s lifetime. A felony DUI is punishable for up to 6-years in prison in the presumptive range of the Colorado Revised Statutes, unless extraordinary aggravation causes a court to enhance the sentence up to 12 years.

I, as well as other attorneys, probation officers and drug and alcohol therapists/ councilors, have all agreed that more thought has to be put into this House Bill 15-1043 or abolish it in it’s entirety. It’s destroying families, future and  any recourse for change. “In a lifetime” must be removed to a case-by-case situation or basis. People do change/ evolve overtime as well as make mistakes. People should not be convicted of a felony for a misdemeanor mistake that has significant time in between occurrences.  It’s wrong...

After 6 years of private contractor service in Afghanistan and Iraq my freedoms were taken because of this new law. A law that I was never aware of until I were charged. After attending a memorial dinner for my late father and my wife as the designated driver left our reunion. I had been drinking and my wife had become sick, enough to collapse in the parking lot from food poisoning, I made a senseless decision to get her in the car and take her home. I acted as I were trained to do so from 6 years of responding to emergency situations overseas. Although, alcohol was involved, I went from hero to felon.  Thank God no one was hurt and no accidents or damages were caused because I drove for seven minutes. Although, I was pulled over just a block away from our home and sighted for DUI that eventually turned into felony DUI due to DUI charges that occurred 24 years prior. I lost my 2nd amendment rights, security clearance for overseas work and the opportunity to retire in our home in Thailand (XO Visa) among more rights available to an American Citizen. My wife will go back to Thailand as she is a Thai citizen and her stay in this country was always considered temporary until retirement and I am forced to stay behind because of this new law. I am very aware and sorry that I made a mistake on November 10, 2017 but the conviction needs to fit the charge. In my case there is no consideration for accomplishments or laps between convictions. 

This is not the America I volunteered, supported and risked my life in active war zones for 6 years in Iraq and Afghanistan to end up having a felony conviction for a misdemeanor offense. I am not the same person as I were 30 years ago. Ask yourself the same question. Thank you for your time. God bless America and abolish House Bill 15-1043
