Eduardo is a Guatemalan immigrant who came to the United States over 10 years ago. He has three US citizen children between the ages of 4 and 9 years old. Eduardo has been detained for over a month. He has absolutely no criminal record and is not threat to society. His children have not seen him since the day he was detained. His children rely on him entirely for their care, love, emotional and financial support. His youngest son suffers from severe asthma and Eduardo is his primary caretaker; responsible for taking him to his medical check-ups and buying his medication. Eduardo is a hardworking father that cares greatly for his children. The absence of Eduardo at home has caused his children to suffer, emotionally and financially. His oldest daughter, typically a vivacious and conversational child, has become withdrawn in school and finds it difficult to participate in group activities. Eduardo has an order of removal from August of 2000, but he has the potential for a U-2 visa, rendering his order moot. His common law wife, and mother of his children, is a bona fide U-Visa applicant as a victim of a serious violent crime.
If Eduardo is sent back to Guatemala it will destroy his family. His children love him very much and need him at their side.
