Dear Industry friends, colleagues and competitors:

I am a young entrepreneurial upstart urban streetwear designer with a company based in Harlem, who finds himself in a David and Goliath battle that could happen to any one of us.

My brand is named EFNY, which is an acronym for Easter Fresh New York. G-III Apparel Group, the massive company that owns DKNY, has filed a lawsuit in the US Trademark Court to prevent me from registering my company’s name and logo because they believe DKNY is the only clothing company that should be able to use the letters NY in their name.

EFNY got off to a great start in 2017.  I design, manufacture, market, promote and sell my own designs. I’ve progressed significantly via hand-to-hand sales, initially through social media exposure, then via Pop Up shop partnerships. Launching and establishing the company is a challenging endeavor but worth every hard earned experience.  

While EFNY sells clothing to everyone, we have a particular fan base with people in the African American community who like to wear urban streetwear.

There might be a very small overlap between the people who like and buy EFNY and the people who like and buy DKNY, but these two brands appeal to very different segments of the marketplace.

G-III Apparel Group is a global billion dollar corporation. In addition to DKNY, they own Andrew Marc, Calvin Klein, Cole Haan, Dockers, GH Bass, Karl Lagerfeld, Kenneth Cole, Levi’s, Tommy Hilfiger, Guess and a number of other brands.

I am at the beginning of my adventure in fashion with EFNY, and despite the fact that my attorney told them that I would agree in contract to never make my logo look like the DKNY logo, this MASSIVE fashion brand Is afraid that people will confuse my small company with their enormous DKNY. This is effectively closing all my viable options to continue building my company and now troubled brand.

I’m calling on support from all small businesses owners and the people who patronize them.

Please repost this letter in support of my small company being allowed to register my EFNY Trademark so that I can protect my brand and keep my company alive.
