Dear Senator Kamala Harris, Senator Bernie Sanders, Senator Jeff Flake, Congressman Elijah Cummmings, and as well as the Department of Justice and the United States Supreme Court
We as the American people send this petition expressing our concern regarding the injustice enacted by the Immigration officers also known as ICE. This type of treatment is just not fair due to the fact the individuals they are gathering are not criminals. These individuals may be undocumented but they are not criminals nor are they a threat to society.
Families are scared and terrified knowing that they will be separated and deported back to their home country. They are scared because some are going to a country that they have never even been and this is the only country they know.
Most, are scared because they hear stories regarding their home country and what is happening such as the criminal aspect and how dangerous it could be.
We as the United States call ourselves land of the free? What is free about separating these families? What opportunities are there?
Additionally, there are Immigration officials that are violating and breaking the Law. They violated the Fourth Amendment of search and seizure, they violated the Laws and Policy of a “Sanctuary State”. They are even harassing, abusing their Power and use of corporal punishment. They even violate the purpose of what this country truly is and stands for.
They have violated the most valuable law of all. That is the Law of the Land which is the Declaration of Independence. I have done a bit of reading, and have discovered by an act of Congress in March 1877 that Congress voted on the Declaration of Independence.
These words, from Section One of the 14th Amendment to the Constitution rank along with the Constitution's Bill of Rights as - in these precincts - the most important in world and American history:No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
It must be concluded that all persons within the territory of the United States are entitled to the protection by those amendments [Fifth and Sixth] and that even undocumented immigrants shall not be held to answer for a capital or other infamous crime, unless on presentment or indictment of a grand jury, nor deprived of life, liberty or property without due process of law.
In summary, the entire case of undocumented immigrants being covered by and protected by the Constitution has been settled law for 129 years and rests on one word: "person." It is the word "person" that connects the dots of "due process" and "equal protection" in the 14th Amendment to the U.S Constitution and it is those five words that make the Constitution of the United States and its 14th amendment the most important political document since the Magna Carta in all world history.
"Aliens," legal and illegal, have the full panoply of constitutional protections American citizens have with three exceptions: voting, some government jobs and gun ownership (and that is now in doubt)
We hereby demand for Immigration officers to be held accountable.
