Sign for the rights of the Disabled to utilize their right to choose where they call HOME. 

My mom has fought cancer for 12 years, colon, breast and lung. I also have a 46 year old special needs brother who has always been home with my mother, never had any help from Department of development disabilities.  He’s classified as cerebral palsy. Wheelchair dependent and needs help with all daily living activities and medication administration.  My mom was put on hospice care May 2019 at home. While still taking care of my brother to the best of her ability and with family members helping out also. In July 2019 I made the hardest decision of my life and that was to put my mother in a Nursing facility I also placed my special needs brother at the same facility so that they could still be together. They were admitted on a 90 day waiver from Medicaid. The family and I was under the assumption that after my mother passes my brother would remain there. The clermont county DD office had to be notified that my brother was there even though he’s never received services. The county Recommended for him to stay at the nursing facility.  When paperwork was sent to Ohio Department of Developmental Disabilities they overruled Clermont County Decision and stated Clermont County was wrong and he could not stay.  We appealed the decision and took it to a state hearing which we lost.  My mother is hanging on at this time and they want to remove my brother to a group home. This is cruel and heartbreaking. We have not told my mother because she is not doing good and said a few weeks ago. She’s glad she don’t have to worry about my brother anymore because he loves it there and they love and take such good care of him. He spends a lot of time in our moms room encouraging her to try to eat, holding her hand and telling her he loves her. He considers the nursing facility his home and  loves the activities and his friends. The state of Ohio who has never even met my brother stated he can’t stay by the bedside of our dying mother.  We will be filing an administrative appeal.  This is where my brother wants to be and considers this his home. Not only is my family and I having to deal with my mom being terminally ill, now the state of Ohio wants to remove my brother from what he considers his home. This would be traumatic for my mother and for my special needs brother.  There are many highly functional individuals that require less assistance placed in nursing facilities but because he is considered DD the state wants him in a group home, when he wants to stay at what he considers his home now and with our mother. My brother needs the right to choose as with other DD individuals.
