If the current COVID-19 crisis has shown us anything it is that not all employers can be trusted to do the right thing by their employees in times of crisis. The Rt Hon Rishi Sunak MP has launched a package of measures that rely on employers playing their part in implementing the welfare protection for employees but the use of furlough is at their discretion. Known public figures and experts such as Martin S Lewis made a public plea to employers https://twitter.com/MartinSLewis/status/1245028064549130242?s=19 explaining they are the gatekeepers of this welfare package, but they are not honouring it. Those that have been working for organisations less than 2 years are easy targets, with limited employment rights and no recourse to employment tribunal to challenge this. Those dearest to me are facing this personal challenge right now in the midst of a global pandemic and not being able to leave the house due to shielding as an extremely vulnerable person - it is nothing short of cruel.

Aside from the gaps in the current policy (discretion could have been firmer), moving forward employees need better protection. I ask that the UK Govt, Dept for Work and Pensions look to pass legislation invoking strengthened workers rights from day 1 of employment:

Strengthen the requirement on employers to implement furlough beyond the current discretion, with evidence required if redundancy is used, and confirm furlough is a suitable alternative to redundancy for the purposes of appeal and employment tribunal

Greater evidence/burden of proof required on the part of the employer to demonstrate fairness in redundancy processes

Improving individual protection in redundancies <20 people to strengthen protections in the process

Greater redundancy pay out protection

Recourse to employment tribunals for employees working for an employer for less than 2 years
