Why this petition matters
On January 15, 2020, Virginia became the 38th state to ratify the Equal Rights Amendment (ERA) to the US Constitution, which deemed this 28th amendment fully ratified. The national archivist's duty is to certify the ERA as the 28th amendment. However, the man in this role at that time refused to do his job, based on guidance from the Trump administration.
In February 2020 and again in March 2021, the US House of Representatives passed a joint resolution declaring the ERA validly ratified. However, Republicans used the filibuster to block this measure in the Senate.
On October 23, 2021, the House Committee of Oversight and Reform, in conjunction with a leading Constitutional law scholar, declared that the amendment is fully and validly ratified and is now part of the Constitution.
On January 27, 2022, this same sentiment was expressed by two Congressional representatives and 154 cosponsors, as they introduced a resolution before the House stating that the ERA had been validly ratified and is now in effect as the 28th Amendment to the US Constitution.
The same day, President Biden expressed his full support for the resolution and the ERA, stating that, "no one should be discriminated against based on their sex--and we, as a nation, must stand up for full women's equality."
However, Republicans are still fighting against the ERA every step of the way. The way I see it, it was unconstitutional for an archivist to not incorporate the 28th amendment in the first place, so there should not be any ongoing discussion or further debate about this topic. It is, and has, been the law since it was first fully ratified. Therefore, SCOTUS' recent move to destroy women's bodily autonomy and right to privacy is unconstitutional and effectively null and void.
