Please prioritize working with Immigration and Customs Enforcement (ICE) to uphold Mr. Julio Ramirez’s constitutional right to due process by allowing him to appear in Cambridge District Court on November 13, 2018, and any subsequent hearings, on Docket #1852CR1063. The Cambridge District Court has properly issued a habeas to ICE as well as the Suffolk County House of Correction requesting that Mr. Ramirez be transported to Court. Mr. Ramirez is a beloved and hardworking business owner, student, and dear friend to many citizens and community organizations in Massachusetts.

Why is this important?

Mr. Ramirez has lived in Massachusetts since 2004. He contributes an enormous amount to the social and economic fabric of his community. Mr. Ramirez is an active volunteer with the legal nonprofit Justice at Work and participates in many community organizations, including the Brazilian Worker Center, Student Immigrant Movement, and Mass Jobs with Justice. Just days before his detention Mr. Ramirez graduated from the leadership course of the Brazilian Worker Center's Building Justice Committee, which trains leaders in the residential construction industry to support workers’ efforts to obtain dignity and justice on the job. Mr. Ramirez has no criminal record, pays his taxes, and owns a small construction company registered in Massachusetts. His industrious spirit and drive to contribute positively to the United States are assets to our community.

In August 2018, Mr. Ramirez was accused of operating a motor vehicle under the influence of alcohol. Mr. Ramirez took this misdemeanor charge seriously and attended two pre-trial hearings to resolve the case. However, before Mr. Ramirez was given the opportunity to resolve this pending case, Immigration and Customs Enforcement (ICE) officers arrested him in the parking lot of Cambridge District Court on October 15, 2018 following a hearing. Since that date, Mr. Ramirez has been held at South Bay ICE Detention Center in Boston. On October 29, 2018 Mr. Ramirez was denied bond by the Boston Immigration Court, despite an outpouring of support from his friends, family, community leaders, and public figures, and his lack of criminal record.

As a result of Mr. Ramirez’s continued detention by ICE, he is UNABLE to resolve the pending criminal case against him unless he is able to appear in Cambridge District Court. This has created a catch-22 situation in which Mr. Ramirez has been denied bond and remains in detention because of the pending charge, and yet cannot defend himself against the pending charge because he is in detention. Furthermore, denying Mr. Ramirez the opportunity to resolve his criminal case, prejudices Mr. Ramirez in any future opportunity to seek legal status in the United States. We ask that you please allow Mr. Ramirez to be transported to Cambridge District Court on November 13, 2018 so he can resolve the pending charge properly and in accordance with his constitutional rights.
