Current Michigan law allows tenants to smoke inside their apartments if a landlord or property manager does not prohibit it. However, due to the nature of multi-family apartment buildings, the resulting second-hand smoke inevitably seeps into neighboring units occupied by non-smokers, their families and children.

This seepage frequently occurs through ventilation systems, ductwork, gaps in doors, wall outlets, as well as common entrances and hallways. To keep smoke from invading their units, renters must often go to great lengths and personal expense to try to mitigate the problem. As this typically fails, the only option is to resign to having to endure the constant exposure.

The significant health risks associated with any level of secondhand smoke are well-established; and current state law is doing nothing to protect the health of non-smoking tenants who suffer involuntarily from these harmful toxins within their own homes and corridors. The long-term consequences have the most profound effect on their children, who are the most vulnerable. In addition, this chronic exposure constitutes a breach of the guaranteed “covenant of quiet enjoyment” provided in all apartment leases. 

As smoking is a confirmed public health problem, and is not granted constitutional protections under Federal law, I propose that Michigan “Public Act 188 of 2009” be amended to prohibit any form of smoking within 25 feet of the exterior of all multi-family residential buildings, including privately-operated apartment complexes. This accommodation would significantly improve the health and well-being of non-smoking families, while not unduly restricting the practices of tenants who smoke.

Breathing smoke-free air should not be a luxury guaranteed only in places of employment or public housing. Please support this petition on behalf of Michigan renters who continue to be unfairly denied the right to a safe and unpolluted environment where it matters most - their homes.
