Jamaican insurance laws are inconsistent with international standards... The FSC is woefully inefficient as an agency to force Jamaican insurance companies to do the job they are required to do by their mandate. This is partly because the current Legal framework governing the insurance industry in Jamaica doesn't clearly hold these insurance companies accountable to pay the claims that they generate in a reasonable (less than three months) time. And these companies are allowed to refuse paying out compensation to victims beyond 14 days, even though these companies are allowed to take an indefinite amount of time (this time base been found to be on an average of a year) to investigate and by extension settle claims. These companies should be liable to pay at least half of the losses that victims experience as a result of being forced to do without their vehicle. The Government of Jamaica claims they want Jamaica to be the place of choice for persons to live, work and raise families. However these social issues are one key factor that causes many prosperous residents of Jamaica not want to return to the country after visiting other territories. The reform of the insurance act should ensure that companies are held to strict standards of customer service and strict timeframe regarding the settlement of claims.
