I am Dr. Victoria Borg. In 2012 I lodged in a complaint with Worksafe about being subjected to bullying at Victoria University. Since WorkSafe decided not to take any action against Victoria University "because it did not breach the Occupational Health and Safety Act 2004" I approached the Victorian Civil and Administrative Tribunal (VCAT) to review this decision. In the meantime, Victoria University terminated my longstanding sessional employment of 15 years without any explanation. Soon after, WorkSafe applied to VCAT to dismiss the case on the grounds that I was not entitled for a review because I was no longer an employee. The application was successful and the case was dismissed.
Some months later I obtained a copy of an 'Entry Report' produced by the Victorian WorkCover Authority / WorkSafe. This report was in relation to my employment records at Victoria University. WorkSafe needed the information in this report to apply to VCAT to dismiss the case.
As a result of a Freedom of Information Request I received a letter from Victoria University stating that WorkSafe did not provide the report to any VU staff member or representative (as stated in the report) and that the document entitled "FC039 Employee Occupancies - Change - 2 pages" does not exit. According to the report Victoria University produced that document on the day of the entry. (NOTE: WorkSafe did not provide me with a copy of this document when I made a Freedom of Information Request).
Both the Victorian Ombudsman and the Freedom of Information Commissioner's Office failed to refer the matter to the Independent Broad-based Anti-corruption Commission (IBAC) for an investigation.
Consequently, I lodged a complaint with IBAC, the Victorian Inspectorate and the Parliamentary Accountability and Oversight Committee, grounding each complaint in its relevant jurisdiction - with no success.
Eventually, I ended up writing a letter to the Premier, Hon. Daniel Andrews about the matter/s in question. I was informed from the Office of the Premier that all correspondence was passed on to Hon. Robin Scott, whose portfolio included WorkSafe. He also failed to order an investigation.
This is a highly concerning matter. The system has failed me all along. As an academic that specialises in mental health and having taught and lectured the subject "Human Relations" for 10 years, I am deeply concerned about bullying, subsequent complaints in the workplace and beyond.
If an academic with a doctorate (like myself) makes a formal complaint and both the university and WorkSafe close ranks, what chances do students have when they make formal complaints about health and safety related matters?
Enough is enough. It's time to stand up and have a voice. The "Entry Report" in question merits an investigation. The onus is now on Daniel Andrews, Premier and Robin Scott MP.
