Ms. Maha Abdel Rahim, was arrested based on an arrest warrant issued by Judge Gary Tranberger on 1/9/2013. The arrest warrant contained a $ 200,000 bond. The arrest warrant is based on family law issues that have occurred in case IND 100236 in Ms. Rahim's family law case that have been heard by the Judge Dale Wells in the Riverside Superior Court.
Ms. Rahim has alleged that Judge Dale Wells took the minor child from Puerto Rico to create an artificial 6 month residency in California. The minor child involved had been living in Puerto Rico with his mother with the consent of both parties prior to the custody trial heard in the family law case, where Judge Dale Wells also adopted an evaluation report by Diana Herrington into evidence that compared the social conditions in Puerto Rico to the social conditions of Indio California, specifically discriminating against the crime rate, education system and available health services in Puerto Rico.
Puerto Rican Senator Leon has expressed outrage at the discriminatory practices employed in Riverside Superior County Court custody evaluation reports, http://viewsandnewsriversidesuperiourcourt.wordpress.com/2013/01/16/purto-rican-senator-rossana-lopez-leon-expresses-outrage-to-the-governor-of-california-and-the-presiding-judge-of-the-riverside-superior-court/
Ms. Rahim has a petition that alleges that the Riverside Superior Court violated the Uniform child act and kidnapped the minor child in this case as his home state was Puerto Rico, by consent of both parties. http://www.change.org/petitions/give-me-back-my-son-of-four-years
We request an investigation into how the resources of the District Attorney's office have been used to bring kidnapping charges against Ms. Maha Abdel Rahim, who is facing pending charges under CA Penal code 278.5 based on the arrest warrant issued by Judge Gary Tranberger. Judge Wells has already sanctioned Ms. Rahim with a non noticed family code 271 sanctions order in July 2012, where she was ordered to pay $ 2500 for an alleged violation of an order made in January 2012. Judge Dale Wells has a long history of issuing malicious rulings against certain litigants that violate any substantive and procedural due process guaranteed under the 14th amendment of the US constitution and the public is petitioning the CA legislative assembly members for a forensic audit of his rulings in the Riverside Superior Court. https://www.change.org/petitions/california-state-auditor-forensic-audit-judge-dale-wells-riverside-superior-court
Ms. Rahim was released without bail on January 15th 2013, pending an extradition hearing for California to be heard in Puerto Rico on the 21st of February 2013.
The actions by the Riverside Superior Court appear to be retaliatory actions and a malicious abuse of power of judicial office as Ms. Rahim has been very public about how her minor son was removed by Judge Wells from Puerto Rico to begin with based on his order after a custody trial in June 2012. If there was indeed a violation of family law proceedings, then under FAMILY LAW, contempt of court proceedings or CCP 177.5 sanctions would apply.
WE are requesting an investigation into how these charges were brought against Ms. Rahim, request any charges by the District Attorney's office to be dropped and that the pending extradition to California be halted.
