Movement of children
17. (2) The movement of children between co-holders of parental responsibilities
and rights or a caregiver, as defined in section 1 (1) of the Children's Act, 2005 (Act No. 38 of 2005), between different metropolitan areas, district municipalities or provinces is allowed if the co-holders of parental responsibilities and rights or a caregiver is in possession of a permit,issued by a magistrate which corresponds with Form 3 of Annexure A
What does this mean. 
In Cape Town for example if one parent is in Somerset West and the other In Stellenbosch. 11km away you may not do this without the permit. 
In Gauteng for example if one parent is in Midrand and the other Centurion only 20 km away you need a permit.
The process for getting the permit can take up to 6 hours at the magistrates courts every time the children need to move. In many family's this is every week or every second weekend.

But it is fine to travel 434 km in the same district to fetch your child with no permit.

The legislation for lockdown is their to protect but this law puts parent at risk at magisterial courts and the reason for this was to protect the children while traveling in a concealed car with no contact with anyone but the people they are living with.

The requirement for the form and permit needs to be removed and the final legislation under level 5 needs to be adopted. This did not restrict the movement of children between districts and only required a birth certificate or court order or parenting plan. 

Remove restriction of movement of children between co-holders of parental responsibilities and rights or a caregiver, as defined in section 1 (1) of the Children's Act, 2005 (Act No. 38 of 2005), in the different metropolitan area or district municipality to act in the best interests of the children and to reduce family conflict.

Law to read

17. (1) The movement of children between co-holders of parental responsibilities and rights or a caregiver, as defined in section 1 (1) of the Children's Act, 2005 (Act No. 38 of 2005), in the same province is allowed subject to the following if the co-holders of parental responsibilities and rights or a caregiver is in possession of-
(a) a court order; or
(b) a parental responsibilities and rights agreement or parenting plan, registered with the family advocate
(c) Affidavit confirming address of each household and original or certified copy of the child's birth certificate if the documentation in paragraphs (a) and (b) is not available.
(2) The movement of children between co-holders of parental responsibilities and rights or a caregiver, as defined in section 1 (1) of the Children's Act, 2005 (Act No. 38 of 2005), between different provinces is allowed if the co-holders of parental responsibilities and rights or a caregiver is in possession of a permit, issued by a magistrate which corresponds with Form 3 of Annexure A The permit will be valid for a period of time and not specific travel times.
