Appoint the City of Kisumu Management Board to improve service delivery to citizens

Section 60 of the Urban Areas and Cities Act no. 13 of 2011 laws of the Republic of Kenya created the Cities of Kisumu and Mombasa in Kenya. The Act was assented to on the 27th August 2011 and came into operation immediately after 3rd March 2013.

Section 12 of the act vests all powers to the County Government of Kisumu in the management of the City of Kisumu but the City shall be administered on behalf the County Government of Kisumu by a board constituted in accordance with section 13 of the act and a manager appointed pursuant to section 28 of the act.

Section 12 (2) of the act further says that the board ... shall be a body corporate with perpetual succession and a common seal and shall, in its corporate name, be capable of suing and being sued; Taking, purchasing or otherwise acquiring, holding, charging or disposing of movable and immovable property; Borrowing money or making investments; entering into contracts; etc etc

Section 20 of the act provides for the Functions of a board which among other things include to oversee the affairs of the city;

Section 21 of the act spells out the powers of the board which includes among other things Ensure provision of services to its residents; Impose such fees, levies and charges as may be authorized by the county government for delivery of services by the city;

Todate, the City of Kisumu Management Board has not been constituted by the County Government of Kisumu thereby greatly compromising service delivery to the residents, dwellers, workers and visitors to the City of Kisumu.

The City of Kisumu Urban Areas Association (CKUAA) is registered under the Societies Act Cap 108 laws of the Republic of Kenya as a Non-Religious, Non-Political and a Not-For-Profit membership body whose main objective is to Promote, Uphold and Protect the highest standards of Urban Governance, Service Delivery, Business Leadership and Ethics in the City of Kisumu.

CKUAA therefore seeks to petition the County Government of Kisumu to appoint the City of Kisumu Management Board in accordance to the Laws of the Republic of Kenya.

CKUAA therefore seeks to collect 200 signatures from the usual residents of the City of Kisumu and other Kenyan citizens to submit this petition by 1st of March 2017
