Kauai Humane Society and Penny Cistaro should be held accountable for breaking the law.

The County of Kauai commissioned a 3-year audit of the Kauai Humane Society. The Kauai Humane Society was found to have violated both State and County laws by killing animals before the mandatory hold period had expired. Non-licensed strays are required to be held 48 hours per KCC Title VIII section 22-10.6, KCC Title VIII section 22-24.4(c) and HRS section 143-8.  Penny Cistaro, the previous Executive Director, instituted a Standard Operational Procedure to immediately kill any kitten under 2 pounds upon intake.  This directive violates the law. The audit shows that in a sampling of 45 animals that had been killed, 30 of those had been killed prior to the expiration of the State and County mandated hold periods. If this random sampling holds true, then it’s entirely possible that the Kauai Humane Society killed two thirds of their animals illegally during the 3-year period. That’s several thousand animals killed illegally.

These illegal actions were brought to the attention of the Board of Directors over two years ago by a concerned community group and several KHS employees. The Board ignored the information, and continued to support Penny Cistaro, allowing her to break the law. If a private citizen breaks the law, they are held accountable. How is it that a County contractor can repeatedly break the law, using taxpayer money, without repercussion?

This petition asks that the County of Kauai hold Penny Cistaro and the Board of Directors of the Kauai Humane Society responsible for gross misconduct and repeated violations of both State and County law.
