Stop local Family Dollar breaking multiple laws and harassing residents.

For the past 7 months, residents surrounding a newly opened Family Dollar located at 3787 Pearl Rd., Cleveland, OH have been continuously harassed. We have been unable to sleep due to various activities performed by the business, and constantly monitored audio and visually in front of our homes. The city is unable to help because it's considered a civil matter, but the Councilman is actively investigating, and attempting to solve, the situation as a nuetral party. The residents that are being directly affected are located within 25-50 ft. from the back of their store, where all of these situations are occurring. There are also many residential homes within 150 ft. of this commercial location that are also being negatively impacted.

This company is currently violating Ohio's "eavesdropping law" by illegally recording the residents, over a privacy fence, audio and visually, without our consent, which points directly into 1 home. Ohio has a one party consent law in regards to audio recording the residents on their surrounding property. They also announce over a speaker outside nonstop, day and night, even when they're closed, reminding residents that they're recording in and outside of the store. This store states repeatedly when they open the store at 7:30 a.m. (before opening), and when they close at 10:00 p.m. and 10:30 p.m. The police were contacted and management was informed that they were violating city noise ordinance laws. This store has also instructed to have their dumpster emptied, the way residential trash is emptied by picking it up and slamming it down one at a time at half hour intervals starting at 5:00 a.m. every other day. Those actions violate the city noise ordinance, the city sanitation and conduct ordinance, and allowing a loud compressed vehicle to be operated between 7:00 p.m. and 7:00 a.m. in a residential area. 

They have gone as far as to alter their property to bypass their sewer by demolishing a section of their flood wall that now floods onto our property since their store is located at an upward slant. They allowed their indoor sewage to drain for one week continuously, which flooded and damaged neighbouring properties because of the alterations.  I was informed on behalf of the residents that this is a private matter to hire a harassment attorney, but a business should not be allowed to bypass the law. 

Please sign this petition so that the residents can again regain peace in our own homes without being monitored, constantly reminded of the recordings, and harassed overall. These instances did not occur with the previous tenants, Aldi's grocery store. We would like the store to monitor their location, not the residents, the audio recording is unnecessary, the announcements are unnecessary and a nuisance, and louder activities should be done according to city ordinances at a reasonable time. We only want peace and the ability to sleep.
