Reverse the decision of the Atlanta Tree Conservation Commission regarding 145 Norwood Rd and 2096 Delano Drive (Appeal 2015-00109)

On March 18th, 2015, the Atlanta Tree Conservation Commission (TCC) failed to adhere to the policy outlined by Sec 158-65(6)b. of the Atlanta Tree Ordinance by sustaining Appeal 2015-00109 (regarding 145 Norwood Road and 2096 Delano Road) in spite of no "erroneous finding of a material fact or...erroneous application of law" by the city arborist, whose decision was the subject of the appeal. Rather than issue a ruling based on their established guidelines, TCC members voted based on their personal bias and opinion as to what constitutes a "best" development plan.
The actions of the TCC on March 18th, 2015 have left the City of Atlanta exposed to litigation in the form of lawsuits which could be filed by: impacted residents of the Kirkwood community who will be harmed by the loss of tax revenue this development would have brought the community, potential home buyers on the property in question, and/or the Developer whose land has now been taken by the TCC. We encourage the City of Atlanta and its elected officials to right this wrong, settle this matter without the unnecessary burden of a trial, and avoid further expense to the City of Atlanta (and its residents) in the form of tax dollars unnecessarily applied to administer and litigate these lawsuits.
