Structured settlement annuitants frequently have their personal contact information obtained by the sleuthing of court records. This personal contact information is sent to a factoring company's sales department for solicitation. Annuitants are contacted relentlessly to the point of harassment, frequently in violation of the Telephone Consumer Protection Act, and have little to no recourse available to them to get the aggressive solicitations to stop.
Annuitants' financial security is in question whenever a factoring transaction is considered and cannot be taken lightly; to be solicited relentlessly is a predatory business practice that should be stopped. The best way to stop this practice is to make the personal contact information contained within the court records private, confidential, and/or sealed. In other words, the personal contact information should be censored or removed from the records, including any personal information that a potential solicitor could use to find the contact information desired to begin making the high pressure sales calls. The act of factoring structured settlements has an appropriate time and place, but it should not result from a high pressure sales pitch comparable to buying a waffle maker.
Protect personal privacy and prevent the victimization of annuitants from overly aggressive factoring companies.
