I have know of and have represented folks who have been pressured into making bad decisions to sell their annuity which was providing them with a basic monthly sum to help support themselves. Once the money from the sale was gone, often spent unwisely because of cognitive difficulties, they were left without this basic monthly sum to help them survive.

Injured people and their lawyers work hard to put in place a financial plan that will maximize the benefit of their settlement, only to have these vultures swoop in and deplete the benefits. Judges who are forced to approve these buy-outs have told me they do so reluctantly and think it's a shame. At those hearings there are usually no counsel for the injured folks, just a representative from the predatory company and the defrauded victim.

It is the right thing to do. Frequently persons with structured settlements are more vulnerable than the population in general. Protecting from predatory lending is appropriate.
