There has been a surge and uptake in criminal activity and drug activity in our community. The incidents are happening in our backyards, next to our homes, next to where we sleep and are suppose to find our comfort and security. Our children are no longer safe outside after dark or unsupervised. We are unable to enjoy the quiet and serenity of our own personal spaces. We have random persons walking through our yards next to our homes, garages, and personal property. We are no longer able to open a garage door while working outside in our yards for fear of turning our back and having our personal possessions stolen only to be sold for the drugs in the community.

We need our voices to be heard by those who rent or manage rental units to those who engage in such illegal activity. We need them to understand by being a part of the problem to the drug and illegal activity in our community, they are causing fear in individuals and leading to the sale of homes by good community citizens. Yes, everyone has a right to live where they choose and we have a right to move. But, why should our right to enjoy our home be impeded by someones right to engage in illegal activity which takes away the freedom of others.

According to the City of Ida Grove Code Chapter 8.05 Nuisances: “Nuisance” means whatever is injurious to health, indecent or offensive to the senses or an obstacle to the free use of property so as essentially to interfere with the comfortable enjoyment of life or property.

Citizens for Taking Back Our Community is petitioning the City of Ida Grove to add to Chapter 1.25.010 Municipal Infractions Landlords or Property Owners/Managers who knowingly or willing allow tenants or guests of tenants to distribute, use, or allow illegal drugs and drug activity within their rental premises.

Chapter 1.25.010 Municipal Infractions:

A violation of, or the omission or failure to perform any act or duty required by this code of ordinances or any ordinance or code herein adopted by reference with the exception of those provisions specifically provided under state law as a felony, an aggravated misdemeanor, or a serious misdemeanor, or a simple misdemeanor under Iowa Code Chapters 705 through 732 is a municipal infraction punishable by civil penalty as provided herein. Citizens for Taking Back Our Community is petitioning the City of Ida Grove to establish the use of the current Penalties for Municipal Infractions to be included in the change in Municipal Infractions on Landlords or Property Owners/Managers who knowingly or willing allow tenants or guests of tenants to distribute, use, or allow illegal drugs and drug activity within their premises which is deemed injurious to health, indecent or offensive to the senses or an obstacle to the free use of property so as essentially to interfere with the comfortable enjoyment of life or property. Landlords through statutory duty must keep leased premises in good repair and must maintain habitability, free from substantial unattractive, annoying, unpleasant, and disruptive nuisances which includes the usage and participation in illegal and drug activity based. This Municipal Infraction is based on Duties of Landlords Iowa Code 562A.15

1.25.010 Penalties for Municipal Infractions:

(1) Standard Civil Penalties.

(a) First Offense. Not to exceed $750.00.
