I received a handbill recently which referred to the case of Hal Herbert. Years ago I knew Mr. Herbert well, and I was astonished when he was charged and convicted at trial in 2003. But I assumed the newspaper accounts of the proceedings were accurate and the evidence they referred to was true.

Now I have to say that I am very startled by the possibility that Mr. Herbert's trial was dependent on false evidence that may have been known to be false at the time it was presented against him. if his current allegations are true then certainly it is incumbent on you to see that he gets an immediate and fair hearing.

Additionally, I feel uneasy about the ethics of the chief Deputy prosecutor who resigned from a US attorney nomination. However, if Mr. Herbert's assertions are not true, I would appreciate hearing from you at your convenience.

I am signing this because mistakes are made all the time. And this case does need to be reinvestigated. The law is in place for a reason. I dont understand why it hasnt been re-examined in the spirit of the law and truth. I am completely disgusted by this.

I've corresponded with Mr. Hebert for 5 years and looked up his history on line. Everything he told me checked out and I could find no reason that he should have been found guilty in the first place. He is a highly intelligent man who clearly still loves and grieves for his wife. He certainly does not deserve to be in prison.

I am signing this petition because the information presented here contains inaccuracies and sketchy assumptions about presumed evidence and testimony. There are more questions than answers that resulted in a life sentence for Hal Hebert and questionable evidence and jurisdictions used to reach that judgment rather than truth. It is cases like this that give the legal system a black eye and ruin innocent lives.

After carefully reviewing the available information I am convinced that this was not really a fair trial. There is information that has not been considered and it appears the most important thing for the government was a conviction, not a fair trial. The least that should be done is a re-evaluation of the facts that are actually provable.

I am signing as after reading all of the information concerning this case, I believe Mr. Hebert was convicted on such blatant testimony, lies, and false information that he deserves a fair trial. Incarcerating an innocent person is not justice. Detective Vigil should be thoroughly investigated as he had a theory, ran with it, and intimidated persons to testify against Mr. Hebert. Detective Vigil had a blatant disregard of facts of the case but could chalk up another successfully closed case.
