Why this petition matters

Started by Christina Roberts

In South Carolina, it is effectively legal for abusers to continue abuse through stalking, coersive control, threats and the family court system itself.

Although there is much work to do, we can close at least one loophole that has to do with stalking. Currently a person, even if they have a restraining order, orders to not be near a residence, family court orders etc, is legally allowed to put hidden audio and visual recording devices in anything considered "marital property" (homes, cars, outdoors on property, cell phones under joint account etc). With divorces taking years to complete in SC this leaves victims open to being secretly or openly recorded and stalked this entire time with no legal ramifications for the abuser.

Although this is looked down upon in family court, contempt hearings are also taking years to being heard.

This specific petition is to change this law to make it illegal for this to continue and to protect the vulnerable.

Closing this loophole will reduce the continued mental, emotional, and physical abuse that is allowed to continue post separation and reduce violence and deaths post separation.

Over 60% of murders of women are committed by ex partners, and most of those once separation had been initiated.
