Mirla Hernandez started this petition to City of Livingston Planning Department and

The parents/community of Livingston strongly oppose the Zoning Ordinance Text Amendment 2018-01, Modifying Provisions of Existing Cannabis Ordinance No. 632 requested by applicant, Dwight Larks, SOTV Main Street.

Specifically, the undersigned parents of Livingston is strongly opposed to any of the following proposed amendments for this project that would allow for cannabis activities of any form:

1. Request to allow all permitted cannabis activities within the downtown commercial zone, DTC (i.e. indoor cannabis cultivation, cannabis manufacturing, cannabis distribution, cannabis testing, and cannabis microbusiness).

2. Request to allow cannabis retail sales in the Downtown Commercial Zone, DTC.

3. Request to eliminate the 600 foot distance requirement between a cannabis activity and a school, daycare, childcare, or youth center.

4. Request to eliminate the 400 foot distance requirement between a cannabis activity and a residential use, park, library, or land zoned for residential use.

5. Request to eliminate the 200 foot distance requirement between a cannabis testing activity and a residential use, park, library, or land zoned for residential use.

The location of this proposed project is a direct school route for a significant number of children that walk to and from school every day. If the proposed project were to be approved, numerous of children would be exposed every day to drug use activities that are illegal for minors. The concern for children being exposed to criminal activity is paramount. This arises the concern for the safety of our children in more ways than one. The safety of our children must be considered and cannot be ignored.

Additionally, this proposed business would be located approximately 600 feet from Selma Herndon Elementary and Casitas Child Care Center. The undersigned parents understand that the schools are strong advocates for students to grow, learn, and succeed “drug-free”. Allowing these amendments would be contradictory to this message.

Our children’s/community's well-being and safety is our number one priority. This location will increase the risk of exposure and safety for students and the community every day. For all the above reasons, the undersigned supporters strongly believes that this location is not suitable.

Below, you will find a list of signatures from our parents, community members, and supporters REQUESTING FOR THE DENIAL of the Zoning Ordinance Text Amendment 2018-01, modifying provisions of existing Cannabis Ordinance No. 632 and all the proposed amendments that would allow for cannabis activity of any type or form.
