Neighbourhoods Not Noise in Hamilton, Ontario

1. Whereas the Doug Ford Conservative Government killed the Drive Clean emissions testing program in 2018;

2. Whereas there is now no system of inspecting vehicles for adherence to any emissions or maintenance standard other than the safety inspection at sale;

3. Whereas many drivers in Hamilton are not maintaining vehicles to safety and emissions standards;

4. Whereas many drivers in Hamilton are installing modified exhaust systems and/or removing mufflers in violation of the Highway Traffic Act for the purpose of producing noise while operating motor vehicles;

5. Whereas noise pollution contributes to negative health outcomes including but not limited to:
              a. Sleep disturbance
              b. High blood pressure
              c. Hypertension
              d. Cardiovascular disease
              e. Cognition and behaviour among children.

6. Whereas since 2018 excessive vehicle noise in Hamilton is a worsening problem with risks to individual and community health; and

7. Whereas excessive vehicle noise erodes quality of life and enjoyment of property; we the undersigned

1. Call on the City of Hamilton and Hamilton Police Services to jointly enforce Hamilton noise by-law 11-285 prohibiting unreasonable noise;

2. Call on Hamilton Police Services to enforce the Highway Traffic Act requiring “Every motor vehicle or motor assisted bicycle shall be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise and excessive smoke, and no person shall use a muffler cut-out, straight exhaust, gutted muffler, hollywood muffler, by-pass or similar device upon a motor vehicle or motor assisted bicycle.  R.S.O. 1990, c. H.8, s. 75 (1)”;

3. Call on Hamilton City Council to request from the province to reinstate a bi-annual emissions test for motor vehicles including for noise and safety as well as particulate emissions;

4. Call on the City of Hamilton to prohibit the altering, amending, or removing of any device, equipment, or software that regulates or suppresses emissions including for noise by any person or business.
