Changes to the Covington, Ky. zoning code regarding short-term rental properties

We respectfully request that the Covington City Commission amend its proposed Neighborhood Development Code (NDC) as it relates to short-term rental properties so that the following changes are incorporated into this code:

  • Change the use categories for the Traditional Urban Residential (TUR), which is the proposed use classification in Historic Licking Riverside, to prohibit both host-occupied and non-host occupied short-term rentals in the TUR district.

The above approach – prohibiting all short-term rentals in the TUR district – is the preferred approach of residents of the Historic Licking Riverside neighborhood. However, if the city seeks to allow for some short-term rentals in the TUR district, then we suggest the following alternative:

  • Change the use categories for in the TUR district to prohibit non-host-occupied short-term rentals but allow host-occupied short-term rentals in the TUR but only as a conditional use, which would require a hearing before the Board of Adjustment to establish conditions allowed for this use.

If the city chooses this alternative, then it should amend the use-specific regulations for residential uses set forth in Article 158.03, Division 07, Section 03.07.3 (E) to include these additional regulations for short-term rentals:

  • Specify the types of buildings where short-term rentals can operate;
  • Limit the number of people in tenant rooms;
  • Impose distance limitations between these types of uses;
  • Require sufficient parking for guests; and
  • Allow conditional uses to be revoked for criminal or civil complaints about a property.

These requested amendments to the proposed Article 158.03 are based on the City of Louisville’s short-term rental ordinance. They are set forth in more detail in a memorandum that was previously submitted to the City Commission by residents of Historic Licking Riverside and we request that the city use the language set forth in this memorandum for these regulations if it decides to take this approach.
