Save my tree. I'm being directed by the city of Charlotte to destroy this beautiful tree

This tree shares a lot with a home that I'm building.  I took steps to protect the tree during the home building process.  The city determined that the steps taken were inadequate and that the tree needs to be removed due to construction damage though no damage can be seen.  In response to the city demand to remove the tree, I engaged Heartwood - a local tree service company - to assess the tree's condition.  They found no significant damage, but did identify a post construction care plan to address the stress the tree encountered during the construction process.

Contrary to claims or suggestions that there has been damage to the root structure of the tree, that just isn't so.  I was present during trenching and grading and that work occurred far from the primary roots.  Further, the city did a high-level inspection and didn't remove any soil to assess primary root health.  

As directed by Heartwood, I intend to undertake the care plan prescribed as soon as construction is complete assuming I'm not forced by the city to destroy the tree.  

I simply ask that the city adopt a wait and see approach. Please give this tree more time to see if there's any actual damage here.  

I'm asking the city to allow me to undertake the prescribed plan of care and to reasses the situation with this tree in a year.
