For the past year, Burns Construction Inc. on 16 Riverside Drive in Ansonia has been running an illegal rock crushing operation. Per the City of Ansonia's zoning regulations, rock crushing is not a permitted use of property in Ansonia. Due to this activity, many residents are unable to live peacefully in the surrounding area. A once peaceful area, excessive noise, vibration from the operations, and dust and debris, has turned all of the area around Burns Construction Inc. into nearly inhabitable.

In 2002, the then owners of 16 Riverside Drive were given a cease-and-desist from then Zoning Enforcement Officer, Peter Crabtree. In 2004, the Connecticut Superior Court sided with ZEO Crabtree, and upheld the regulations which designates that rock crushing is not permitted in Ansonia.

Despite legal precedent on this matter, from both a zoning regulatory perspective and a judicial perspective, Ansonia's current ZEO, David Blackwell, says that he does not interpret the regulations as such. Despite many complaints about this issue from more than 200 residents in Ansonia, the city and the zoning board of appeals continues to turn a blind eye to this very glaring issue hurting our residents.

The planning and zoning commission may now be faced with a decision to amend Ansonia's zoning regulations to make rock crushing a permitted use of property in Ansonia. It is perplexing that this is the route that is being taken, considering our ZEO, David Blackwell, claims it is indeed a permitted use. The ramifications of allowing rock crushing in Ansonia could affect more than just the residents in the vicinity of the disturbance caused by Burns Construction Inc. on Riverside Drive. 

It is disturbing that the administration of Ansonia believe that they can get away with this because of the location of Burns Construction Inc. Riverside Drive and the surrounding area is inhabited by a large minority populous, and the administration's lack of action on this issue shows that there is a deep disrespect for the residents of this area. This is economic racism in its purest form.

By signing this petition, whether you are being affected by this illegal operation or not, you will be standing on the side of justice for the hundreds of residents here in Ansonia whose peace is being greatly disturbed at all hours and all days of the week by this illegal operation. You will also help to ensure that no other residents in the City of Ansonia will have to bear the burden that rock crushing operations imposes on the surrounding area.
