We, the undersigned residents and owners of property located in the gated community of Summit Creek of Woodland Hills, Utah County, hereby demand that the City Council and Mayor take immediate action to reactivate our community’s gates and refrain from taking any action that would remove them or otherwise alter the purpose for which they are installed.
 
One of the principal reasons we purchased homes and lots in Summit Creek is because it was represented to be a gated community, with all of the unique and valuable property rights associated with a gated community. These valuable property rights include, but are not limited to, significantly increased security from potential criminal activity and vandalism, enhanced safety by reducing the presence of non-residents and the increased flow of traffic from those who do not live in our community, deprivation of our use and enjoyment of our properties, and the absence of dangers posed to our children and us from unsafe traffic speeds. Any permanent opening of the gates, or the removal thereof, defeats all of the benefits of a gated community and would constitute an unlawful taking of our valuable property rights. If the gates were to remain open or be removed, it would defeat the very purpose for which a gated community like Summit Creek was developed, not to mention the resultant reduction in the security, safety and value of our properties. Again, we strongly oppose the deactivation or removal of the gates to Summit Creek and will take all action necessary to protect our interests. Other considerations include:
 
- Summit Creek has always been treated as a gated master planned development from its inception, and evidenced by several facets
- Summit Creek has a separate and apart postal service distribution center
- When Utopia fiber was run through the city, it excluded Summit Creek
- Woodland Hills approved lot sizes and setbacks based upon a gated master planned community
- Road construction, and drainage are different than the rest of Woodland Hills
- Woodland Hills approved a pool complex on the main gated road
- The plat approved by the city describes Gates/Monuments for the master planned development
- Only after the fires in 2018, did the city push to have the gates open and removed
- There are more lot and home owners in Summit Creek, than in the above Woodland Hills vicinity of Summit Creek
- The gates have been present since the inception of the Summit Creek Master Planned Development
- The gates do not prohibit through traffic, they only seek to inhibit non resident or related party traffic
- The city has not shown any data to support that the gates have caused any detrimental harm to the residents of Summit Creek
- Summit Creek was developed with a traffic plan for a gated community and no traffic study has been conducted that would indicate that the community could absorb the increased traffic
