Currently the child maintenance service is calculating the amount to pay based on gross taxable income. What does it mean? Your weekly earning before tax and money not paid in such medical benefits, are summed together (£500.00 Gross income + £25.00 Medical benefit not paid in + £125.00 Overtime = £650.00). If you are paid weekly, they will consider the last 5 payslips, summed all together and divided by 5 (the number of payslips); the total will be divided by 7 (the number of days per week); the total will be multiplied by 365 (the days in the year). More overtime you do, higher will be your weekly child maintenance to pay, and indeed higher will be your estimate annual income. To be noted, CMS will not take into consideration your contract and how much is your real annual income before taxes. The will consider always the highest amount earned even if the overtime is not guaranteed and not part of your contract, they will consider it. So, if you do overtime to keep up with the bills and mortgage your ex left you with, more child maintenance you will pay; less overtime you will do to reduce the child maintenance and keep up with your bills, less you will earn and do not copy with your expenses. Either way, CMS, will make you poor with a high risk to end in the street.

No one plans their expenses based on gross income, overtime and medical benefit!

I do believe this is a barbaric way of calculating the child maintenance, with the only aim to create financial destress to parents who need to pay.

In my case, not just my daughter has been deprived by her loved father by the abusive mother, but I need to pay a high Child Maintenance because I did overtime to pay the bills and to pay to see my daughter.

I am calling the government to review this barbaric way to calculate the amount, the income of the mother or the living-in parent should also to be taken into consideration, as well as all the expenses the left behind parent has been left on to pay.

Indeed, this way does not give fathers the possibility to live a decent life, therefor deprived from his human rights.
