Dear Sir,

The nomination of former Chief Justice of India, Ranjan Gogoi as a Rajya Sabha member is a clear violation of the Article 80, clause 1, sub-clause (a) read with clause 3 of the Constitution of India as he does NOT comes from a background of "Literature, science, art and social service" which is a BASIC REQUIREMENT to be NOMINATED TO RAJYA SABHA. Being a Judge, he cannot claim to have done social service as he is just a public servant.

Is it fair on the part of "Honourable" Justice Ranjan Gogoi, who as a former Chief Justice of India was responsible for upholding the Constitution of India, to accept this nomination which is against the provisions of the same Constitution of India that he swore to uphold?

Out of 110 members nominated to Rajya Sabha from the year 1952 till today, it is crystal clear that no judge has been nominated as a Rajya Sabha member. A few Judges might have been ELECTED after 4 to 7 years after they retired, but they were NOT NOMINATED like Ranjan Gogoi & that too, just within 4 months after his retirement. Only eminent advocates who have done yeoman services to the society have been nominated as Rajya Sabha members, apart from eminent artists, authors, scientists, film makers, musicians, sportspersons, singers, film makers, painters, economists, poets, politicians with social service background etc.. But, the “Nomination” of Justice Ranjan Gogoi to Rajya Sabha under Article 80, clause 1, sub-clause (a) certainly violates the conditions prescribed in clause 3 of Article 80 of the Constitution of India.

Through this Online Petition, we the undersigned humbly request the Current Honourable Chief Justice of India to take suo moto action under Article 32 of the Constitution of India with a Writ of Certiori to remove the Nominated Appointment of Ranjan Gogoi to Rajya Sabha as it is unconstitutional when it is read with clause 3 of Article 80 read with sub-clause (a), clause 1 of Article 80 through which the said Nomination has been made by the President of India.
