Carve-Out in Canada’s November 14 2022 Policy on the Inadmissibility of Iranian officials

The Issue

Purpose

We, the undersigned, call upon the Government of Canada to amend and clarify the implementation of the November 14 2022 policy (Public Safety Canada / CBSA News Release: “Senior officials of the Iranian government officially banned from Canada”), which renders certain individuals inadmissible under section 35(1)(b) of the Immigration and Refugee Protection Act (IRPA).

The purpose of this policy—to hold accountable those complicit in the Islamic Republic’s human-rights abuses—is vital and commendable.  It should continue to be vigorously applied against current regime functionaries.

However, the policy’s present interpretation lacks a clear carve-out for genuine defectors and opposition figures, thereby sweeping in individuals whose political and moral break with the regime has placed them in danger.

Misuse and Political Weaponization

Without explicit interpretive guidance, the 2022 policy has been politically weaponized.

Certain self-described human-rights activists now invoke it selectively to attack political rivals within the Iranian opposition—especially those associated with the monarchist or pro-liberal-democracy movements—while ignoring others of different orientations.

This selective misuse erodes fairness and transforms a human-rights tool into a means of political persecution within Canada’s borders.  It undermines both the credibility of our immigration system and the principles of non-refoulement that Canada is bound to uphold.

Case in Point: Mehdi Nasiri Lalardi

The experience of Mehdi Nasiri Lalardi illustrates this problem.

Mr. Nasiri Lalardi has been accused of falling under the 2022 policy on the grounds that he is alleged to have been a senior public official of the Islamic Republic of Iran and therefore inadmissible under section 35(1)(b) of the IRPA.

In reality, he has openly defected from the regime, embraced monarchist and pro-peace positions, and has consistently raised his voice against anti-Semitic and anti-Israel sentiments in the region.

Because of this, he has faced credible threats and vilification campaigns from both regime-aligned actors and certain opposition figures exploiting this policy for partisan ends.

He remains separated from his family, in legal limbo, and at real risk of persecution or worse if returned to Iran.  Those seeking his deportation are, knowingly or not, serving the regime’s objectives by attempting to silence and endanger one of its outspoken defectors.

Our Call for Action

We urge the Government of Canada to:

1. Clarify the interpretation of the November 14 2022 policy so that it applies only to individuals who remain complicit in, or supportive of, the regime’s conduct.

2. Establish a formal carve-out or waiver process for persons who can credibly demonstrate that they:

• Have renounced allegiance to the regime;

• Have joined or supported the democratic opposition; and

• Face a well-founded risk of persecution, imprisonment, or torture if removed to Iran.

3. Prevent political misuse of the policy within Canada’s diaspora communities by ensuring transparent, evidence-based decision-making.

4. Provide interim dignity to those awaiting determination, including basic legal status, work authorization, and family reunification opportunities.

Legal and Moral Basis

Canada is bound by its international obligations under the 1951 Refugee Convention, the Convention Against Torture, and section 7 of the Canadian Charter of Rights and Freedoms.

These instruments prohibit refoulement of individuals to countries where they face persecution or torture.  Applying section 35(1)(b) to bona fide defectors contravenes those obligations and Canada’s own humanitarian tradition.

Conclusion

The November 14 2022 policy is just, necessary, and worthy of full enforcement against those who sustain the Iranian regime.

But its fairness and legitimacy depend on precision—on ensuring that it does not ensnare defectors and opposition figures whose very defection represents a stand for freedom and human rights.

 We therefore call upon the Government of Canada to clarify and amend the 2022 policy to include a carve-out for genuine defectors, thereby preserving the policy’s integrity and upholding Canada’s humanitarian commitments.

دادخواست برای اصلاح سیاست و قانون دولت کانادا (۱۴ نوامبر ۲۰۲۲) دربارهٔ عدم پذیرش مسئولان ایرانی

خطاب به:

وزیر محترم امنیت عمومی و آمادگی اضطراری

وزیر محترم مهاجرت، پناهندگان و شهروندی کانادا

هدف

ما امضاکنندگان، از دولت کانادا درخواست می‌کنیم سیاست و مصوبه ۱۴ نوامبر ۲۰۲۲ (بیانیهٔ خبری وزارت امنیت عمومی/سازمان خدمات مرزی کانادا: «مقامات ارشد دولت ایران رسماً از ورود به کانادا منع شدند») را اصلاح و روشن‌سازی کند؛ قانونی که طبق بند 35(1)(b) قانون حمایت از مهاجرت و پناهندگی (IRPA)، برخی افراد را غیرقابل پذیرش اعلام می‌کند.

هدف این سیاست و قانون - یعنی پاسخگو ساختنِ افراد همدست در نقض حقوق بشر توسط جمهوری اسلامی - ضروری و قابل ستایش است و باید همچنان با جدیت در مورد کارگزاران فعلی رژیم اعمال شود.

با این حال، تفسیر فعلی از این قانون  فاقد یک استثنا (carve-out) برای جداشدگان واقعی و چهره‌های اپوزیسیون است و باعث شده افرادی که به‌طور سیاسی و اخلاقی از رژیم گسسته‌اند نیز ناعادلانه در دایرهٔ این قانون قرار بگیرند.

نبود یک تفسیر روشن، موجب شده تا از این قانون سوءاستفاده سیاسی شود.

برخی افراد که خود را «فعال حقوق بشر» معرفی می‌کنند، این قانون را به‌صورت گزینشی برای حمله به رقبای سیاسی‌شان در اپوزیسیون ایرانی—به‌ویژه افرادی که با جریان پادشاهی‌خواه یا لیبرال‌دموکرات همسو هستند—به‌کار می‌گیرند و در مقابل نسبت به افراد دیگر از گرایش‌های مختلف کاملاً بی‌تفاوت‌اند.

این استفادهٔ گزینشی، اصل انصاف را مخدوش کرده و یک ابزار حقوق‌بشری را به وسیله‌ای برای آزار سیاسی در داخل مرزهای کانادا تبدیل می‌کند. چنین امری، اعتبار نظام مهاجرتی و اصول «عدم بازگردانی» (non-refoulement) را که کانادا موظف به رعایت آن است، تضعیف می‌کند.

نمونهٔ موردی: مهدی نصیری 

تجربهٔ مهدی نصیری نمونه‌ای از این مشکل است.

آقای نصیری بر اساس ادعای این‌که گویا از مقامات ارشد جمهوری اسلامی بوده، متهم شده که مشمول قانون ۲۰۲۲ و طبق بند 35(1)(b) قانون مهاجرت، «غیرقابل پذیرش» است.

در واقعیت، او به‌طور علنی از رژیم جدا شده، مواضع پادشاهی‌خواهانه و  صلح‌طلب اتخاذ کرده و علیه یهود ستیزی و اسراییل ستیزی در منطقه فعالیت نموده و با تهدیدهای واقعی و کارزارهای تخریب از سوی هم عوامل همسو با رژیم و هم برخی افراد در اپوزیسیون (که این قانون را ابزار حمله قرار داده‌اند) روبه‌روست.

او همچنان از خانواده‌اش جدا مانده، در وضعیت حقوقی بلاتکلیف قرار دارد و در صورت بازگردانی به ایران با خطر جدی آزار، زندان یا بدتر از آن مواجه خواهد بود. تلاش کسانی که به دنبال اخراج او هستند—آگاهانه یا ناآگاهانه—در راستای منافع رژیم جمهوری اسلامی  عمل می‌کنند، زیرا می‌کوشند یکی از جداشدگان فعال و منتقد رژیم را ساکت و در معرض خطر قرار دهند.

درخواست ما برای اقدام

ما از دولت کانادا می‌خواهیم:

تفسیری روشن از قانون ۱۴ نوامبر ۲۰۲۲ ارائه کند تا فقط شامل افرادی باشد که همچنان در عملکردهای رژیم نقش دارند یا از آن حمایت می‌کنند.

یک روند رسمی برای استثنا یا معافیت برای افرادی ایجاد کند که بتوانند به‌طور معتبر نشان دهند:

• وفاداری خود را به رژیم قطع کرده‌اند؛

• به اپوزیسیون دموکراتیک پیوسته یا از آن حمایت می‌کنند؛

• در صورت بازگردانی به ایران، با خطر آزار، زندان یا شکنجه روبه‌رو هستند.

از سوءاستفادهٔ سیاسی از این قانون در میان جوامع مهاجر ایرانی جلوگیری کند و تصمیم‌گیری را شفاف و مبتنی بر شواهد سازد.

تا زمان تعیین تکلیف نهایی، حداقل حقوق اولیه همانند وضعیت قانونی موقت، اجازهٔ کار و امکان پیوست خانواده را برای افراد فراهم کند.

مبنای حقوقی و اخلاقی

کانادا طبق تعهدات خود ذیل کنوانسیون ۱۹۵۱ پناهندگان، کنوانسیون منع شکنجه و بخش ۷ منشور حقوق و آزادی‌های کانادا، ملزم است از بازگرداندن افرادی که با خطر شکنجه یا آزار روبه‌رو هستند خودداری کند.

اعمال بند 35(1)(b) در مورد جداشدگان واقعی از رژیم، با این تعهدات و سنت انسان‌دوستانهٔ کانادا در تضاد است.

جمع‌بندی

قانون ۱۴ نوامبر ۲۰۲۲ سیاستی درست، ضروری و شایستهٔ اجرا علیه افرادی است که به تداوم رژیم جمهوری اسلامی ایران کمک می‌کنند.

اما اعتبار و عدالت این سیاست و قانون  وابسته به دقت و این تمایزگذاری است که افرادی را که جدا شدنِ آنان خود نوعی ایستادگی در برابر استبداد و دفاع از حقوق بشر است، گرفتار نکند.

از این رو ما از دولت کانادا می‌خواهیم مصوبه ۲۰۲۲ را اصلاح و برای جداشدگان واقعی یک استثنا (carve-out) قائل شود، تا هم تمامیت این سیاست و قانون حفظ شود و هم تعهدات انسانی کانادا محترم بماند.//
