 Ref. Su carta de apoyo a la Señora Forcadell faltando a la democracia española

Estimado Sr. Peumans,

Le escribimos en nombre de una plataforma de ciudadanos españoles que desean compartir con usted nuestra gran preocupación por la carta que envió recientemente a la Sra. Forcadell y que se publicó en varios medios de prensa.

En particular, nos preocupa su percepción de los eventos que se han desarrollado en los últimos meses en Cataluña, España. Tenemos la impresión de que ha recibido sólo un lado de la historia, la de los separatistas, y nos gustaría recordarle que la crisis catalana también tiene protagonistas que no apoyan el separatismo. Según los resultados de las últimas elecciones regionales, los ciudadanos catalanes que desean formar parte de una Cataluña dentro de España son, de hecho, la mayoría de la población catalana.

Como dijo el Sr. Juncker, Presidente de la Comisión Europea durante el Estado de la Unión dirigido al Parlamento Europeo en Octubre de 2017, la UE no es un Estado sino una "Comunidad de Derecho".

El gobierno regional de Cataluña no sólo ha ignorado la ley y el marco constitucional, sino que ha alentado a muchos ciudadanos catalanes a la desobediencia, la rebelión y, en última instancia, a estar fuera de la ley. El "plebiscito unilateral" del 1 de octubre de 2017 se organizó violando la Constitución y el Estado de Derecho e ignorando la "mayoría silenciosa" de la población de Cataluña, que no es independentista.

Como han destacado los líderes políticos de la UE, el respeto por el Estado de Derecho "no es una opción" y si la Ley "…no te da lo que deseas, puedes oponerte a la Ley, puedes trabajar para cambiar la Ley, pero no puedes ignorar la Ley…".

En relación con los desafortunados comentarios vertidos en su carta contra España, su democracia y su sistema judicial, queremos informarle que España es un Estado de Derecho en el que las decisiones judiciales y las solicitudes de la Fiscalía están sujetas, además de a un sistema híper-garantista en la investigación y enjuiciamiento de las personas investigadas, al control y la crítica de la opinión pública sin ningún tipo de interferencia y con total transparencia. Según el Convenio Europeo de Derechos Humanos, España es uno de los Estados Miembros de la UE con un menor número de violaciones de los derechos humanos.

La señora Forcadell no es una presa política ni de opinión. Ni ella ni ningún otro líder político catalán arrestado. A este respecto, me gustaría invitarle a consultar el informe elaborado por Amnistía Internacional, que niega claramente sus acusaciones y fue ampliamente publicado en prensa internacional, incluida la prensa belga (ver: https://t.co/AM13mw3NTM

Nos gustaría informarle que "Freedom House[1]" puntuó el nivel y la calidad de la Democracia Española en su Informe de Freedom in the World de 2018 con 95 puntos sobre 100, esto es, al mismo nivel de otras democracias occidentales como Alemania, Austria, Reino Unido, y mucho mejor situadas por ejemplo que otras democracias Europeas o de la de Estados Unidos.

Además, nos gustaría invitarle a consultar el ""Democracy Index of the Economist Intelligence Unit"[2] en relación con la calidad de la Democracia en España. Según este Índice de Democracia, España tiene un nivel de democracia "COMPLETA" (+8,08), similar a otras democracias de otros Estados miembros de la Unión Europea como Alemania u Holanda, y mejor situada que otras democracias occidentales como por ejemplo, Bélgica (+7.78, lo que clasificaría a ésta democracia bajo el segmento de democracias "defectuosas").

Sobre la base de lo anterior, es por lo tanto contradictorio y difícil de entender que usted, como representante del Parlamento Flamenco (un Parlamento actualmente representado con miles de votos a favor de la extrema derecha) venga a dar lecciones de democracia a un estado soberano de la UE, como es España.

Si bien no tenemos nada en contra de que usted le escriba una carta de apoyo a la señora Forcadell (que estoy seguro que ella lo apreciará en esos momentos especialmente difíciles), no vemos la necesidad de incluir en esa carta insultos a España o a sus instituciones democráticas. Una cosa no obliga a la otra.

Por lo tanto, le agradeceríamos que usted, como representante público de los ciudadanos belgas, piense con más cuidado antes de hacer declaraciones erróneas y falsas, insultando a España, su democracia y su sistema judicial.

Estamos seguros de que comprenderá nuestras inquietudes por sus comentarios tan desafortunados.

Finalmente, me gustaría recordarle que no hay democracia sin ley y que el Tratado de la Unión Europea y las Constituciones de los Estados Miembros de la UE son los pilares que garantizan nuestros derechos y libertades como ciudadanos.

 Ref: Your letter of support to Mrs. Forcadell questionning the Spanish Democracy

 Dear Mr. Peumans,

 We are writing to you on behalf of a platform of Spanish citizens wishing to share with you our great concern about the letter you recently sent to Mrs. Forcadell and published in several press media.

 More specifically, we are concerned about your perception of the events that have unfolded in past months in Catalonia, Spain. We have the impression that you have received one side of the story, that of the separatists, but we would like to remind you that the Catalan crisis also has protagonists who do not support separatism. Based on the results of the last regional elections, those wishing to be part of a Catalonia within Spain are in fact the majority of the Catalan population.

 As Mr. Juncker, President of the European Commission referred during the State of the Union addressed to the European Parliament during October 2017, the EU is not a State but a "Community of Law".

The Catalan regional government not only have ignored the Law and the constitutional framework but have encouraged many Catalan citizens to disobedience, rebellion and ultimately to be outside the law. The "unilateral plebiscite" of 1 October 2017 was organized violating the Constitution and the Rule of Law and ignoring the “silent majority” of the population of Catalonia.

 As EU political leaders have highlighted, the respect for the Rule of Law "is not an option" and if the Law "does not give you what you want, you can oppose the Law, you can work to change the Law, but you cannot ignore the Law….".

In relation to your unfortunate comments spilled in your letter against Spain, its Democracy and his Rule of Law, we would like to inform that Spain is a State of Law in which the judicial decisions and the requests of the Prosecutor's Office are subject, in addition to a hyper-guarantee system in the investigation and prosecution of those under investigation, to the control and to the criticism of public opinion without any type of interference and with total transparency. According to the European Convention of Human Rights, Spain is one of the Member States of the EU with a lower level of violations of human rights.

Mrs Forcadell is not political or opinion prisoner. Neither she nor any other Catalan political leader arrested. At this respect, I would invite you to consult the report produced by Amnesty International, which clearly denies your accusations. The latter was widely published at different international press media, including the Belgian press (see: https://t.co/AM13mw3NTM

 In addition, I would like to inform you that "The Freedom House"[1] scored the level and the quality of Freedom in the Spanish Democracy at its Freedom in the Wold Report of 2018 with 95 points out of 100, this is, at the same level of other western democracies like Germany, Austria, UK, or much better placed that in US or other major EU Member States.

In relation to the quality of Democracy in Spain, we would also like to invite you to consult the "Democracy Index of the Economist Intelligence Unit"[2]. According to this Democracy Index, Spain has a level of "complete or FULL" democracy (+8,08), similar to other democracies of other Member States of the European Union like Germany or Holland, and better placed than other western democracies like for instances, Belgium (rated with +7.78, falling under the segment of "Flawed" democracies).

On the bases of the above, it is therefore contradictory and difficult to understand that you, as representative of the Flemish Parliament (flooded with thousands of votes for the extreme right) come to give lessons of democracy to a sovereign EU Member State like Spain.

While we have nothing against the fact you write a letter of support to Mrs Forcadell (which I am sure she will appreciate in those difficult moments for her), we do not see the need to insult Spain or their democratic institutions at the same time. One thing does not obligate to the other.

Therefore we would appreciate if you, as public representatives of Belgian citizens, think more carefully before making wrong and false statements about Spain, its democracy and its judicial system.

We are sure you will understand our concerns in relation to your unfortunate comments.

Finally, I would like to remind you that there is no Democracy without Law and the EU Treaty and Constitutions of EU Member States are the pillars that guarantee our rights and freedoms.
