On the afternoon of June 25, 2018, Barney Provost was killed in a head-on collision on Highway 3 by Douglas Bagnall, an intoxicated driver who’s blood alcohol content was more than 2x the legal limit. Bagnall was travelling highway speed heading eastbound on a westbound divided highway. 63 year old Bagnall had a prior impaired driving conviction resulting in a $1000 fine and 1 year driving suspension. 
Barney Provost was 42 years old at the time of the accident and leaves behind a wife and 4 young children (the oldest of which was in the passenger seat during the time of the accident but sustained minor injuries). Barney was a proud member of the Piikani Nation and was a former vice principal of our communities secondary school, basketball coach and elected member of the Piikani Chief and Council. Barney was a role model for his Blackfoot people, encouraged education and was an advocate for sobriety. 
June 22, 2020, Douglas Bagnall was sentenced to 5 years after pleading guilty to dangerous driving causing death, with a 2 year credit for pretrial custody he will likely serve 3 years in jail. 
Barney’s 4 young children will grow up without their dad, his loving widow will raise their children alone. Our community has lost a profound leader who was making way for a brighter future for our Blackfoot youth. The repercussions of Barney’s death are felt throughout Southern Alberta and beyond and his life meant more to his family and community than just 3 years in jail. Douglas Bagnall made the conscious decision to drive while intoxicated, resulting in the death of Barney Provost and for that he should serve a mandatory life sentence. According to the trial judge residing over the trial of Bagnall, he faced a maximum sentence of 16 years and only got 5. I, the petitioner and niece of Barney,  propose that convicted persons who drive while intoxicated and cause death or bodily harm and have a previous DUI serve a mandatory life sentence of 25 years.
