On May 13, 2019 at about 10:40pm, Baytown Police Officer Juan Delacruz shot Pamela Turner 3 times resulting in her unjustifiable death as she was on her way home at 1601 Garth Road in Baytown, Texas, also known as The Brixton Apartment complex. Juan Delacruz stated in his walk through video that he only searched for Pamela’s name because he knew she’d had a prior run in with the leasing manager of the apartment building, and intentionally sought after her for this reason. In fact, Juan Delacruz himself lived in the same apartment complex as Pamela Turner and was very familiar with her and her condition. Juan Delacruz knew at the time of confrontation that Pamela Turner suffered from Mental Health issues and violated his Police Department’s orders, policy, and procedures to call for the Mental Crisis unit at the Baytown Police Department when dealing with a mentally I’ll subject. With knowing all of this information about Pamela Turner, Juan Delacruz then approached her at 10:40pm in attempt to arrest her for a misdemeanor warrant for missing a court date. Ms. Turner proceeds to continue walking home as she does not know why Delacruz is trying to arrest her. She even yells out “Why?!” Several times in confusion as the officer never states to her what she has done to deserve this. Delacruz goes on to Tase Ms. Turner in the right leg and eventually wrestles her to the ground. He then stands over her as she lays on her back, steps about 3-5 feet away from her, draws his weapon, and fires 5 shots as Ms. Turner sat up and looked at him. Pamela Turner was shot in her face, chest, and stomach. Delacruz claimed that Ms. Turner gained control of the taser and he was tased in the right testicular area, however, there is no evidence at all to prove that. The officer did not yell out in pain, show signs to reflect any pain in the video captured by bystanders, nor did he seek any medical attention to make sure he did not sustain any injuries. On October 6, 2022 a trial was presented to a jury that received a teaspoon of what actually occurred. Judge Chuck Silverman would not allow in any evidence about Juan Delacruz‘s familiarity with Pamela, the Policy and Procedures that Juan Delacruz violated within the Baytown Police Department, or that Juan Delacruz had prior knowledge of Pamela Turner’s mental illness and was in clear violation of the ADA, Americans with Disabilities Act. With the jury being uninformed they provided a Not Guilty verdict. We ask that the Department of Justice indict Juan Delacruz for the murder of Pamela Turner on May 13, 2019 and allow for a fair trial to be conducted, as Ms. Turner was intentionally robbed of her due diligence and the opportunity for Juan Delacruz to accurately be held accountable for her death. If the Department of Justice decides to Indict Officer Juan Delacruz, they will be giving a new and fair trial to Ms. Turner and her family. They will bring hope back into the justice system and make a stance that unfair treatment of any case will not be tolerated.
