  I feel there is a serious problem with the legal punishment for semi truck drivers  involved in a vehicle accident where people/persons are injured/killed due to negligence to a certain level. My husband was on his way home from work in stop and go traffic, traveling 5-7 mph tops when a semi truck rammed into them from behind going 47mph. Several people were seriously injured, one of the victims went thru the windshield others were sent to hospital to get treated, my husband Tommy was found dead in the backseat of his car. When semi driver was asked why he didn’t stop he told CHP “ I must’ve been distracted, I was obviously doing something else” that comment haunts me daily, that is an extremely long amount of time and distance to be distracted. The fact that from .9 mile away he was first able to see traffic as well as from .4 mile before the site where there crash occurred and he did not even attempt to brake until last second if that as speed on impact was 47 mph… semis drivers are to do one thing and that’s -drive the truck safely- which he did not do in any way shape or form. The D.A. Got in touch with me regarding the legal proceeding and informed me it was considered a misdeamenor and max was 1 year in jail (are you  series) The judge is now offering 90-120 days in or outta jail & will be allowed to get behind the wheel of a semi to do this again without any suspension/classes at the least.

I understand an accident is an accident but when circumstances are as blatantly obvious as this and  gross negligence is deemed a charge against the person I believe it should be a felony charge for the person who was accountable for the crime as well as drivers license taken for a certain amount of time or till certain requirements are met if at all.
So In 3-4 months as my husband Tommy Muñoz family and friends who are forever mourning the loss of a Son, Brother, Husband, Father, Cousin, Friend just an amazing loving man that has touched so many lives are forced to keep living & move on with our lives without Tommy. As for the truck driver in 3-4 months  he can be back on the road like nothing ever happened, he’ll be able to see his friends & family. Sure with the thought of the accident in back of his head but at least he is able to continue life as Tommy can no longer do due to semi drivers actions and negligence..
