California Independent Voter Rights Act by Independent Self-funded Candidate Fuji Shioura For California Governor 2018

Dear Governor, and members of our California State Assembly and State Senate,

As Governor, you are responsible for administering and enforcing the laws of California. As elected members of the California State Assembly and State Senate, you have the principle law-making powers in our state.

This petition is to address an unnecessary impediment and unfair burden for California voters to vote for eligible Independent candidates of their choice.This petition requires your immediate attention before our California's June 5th, 2018 Primary. We are Independent voters that know that the unnecessary impediment is intentional and the unfair burden is willful. 

We are Independent voters that do not want to align ourselves with an established political party. We are Independent voters because many of us in California are voters who want to vote for candidates on issues rather than on the basis of a political ideology or partisanship. We are Independent voters who do not have or want long-standing loyalty to, or identification with, an established political party, such as the Democrat Party, Republican Party or the American Independent Party.

We are Independent voters that want common sense to prevail and not politically contrived schemes to prevent, deter and confuse Independent voters from voting for genuine Independent candidates not affiliated with an established political party. 

Presently a candidate with no affiliation, support or membership with established political parties, like the Democrats, Republicans and American Independent Party, must file as NPP or No Party Affiliation with our California’s Secretary of State.

An Independent candidate with no affiliation, support or membership with established political parties cannot file as Independent with our California’s Secretary of State.

Yet, candidates, members or supporters of the American Independent Party are permitted to file as “Independent” or “American Independent Party”.  

This is unfair, wrong and dangerous to our democracy. It is unfair because many California voters are confused by the vagueness of NPP (No Party Preference) label.  

It is wrong because many voters in California want to vote for Independent candidates and not for a candidate with an established political party affiliation, especially for a political party like the American Independent Party. Many California voters, like myself, know next to nothing about the American Independent Party.

It is dangerous to our democracy because the primary goal of a democracy is ideally to empower citizens to vote for candidates of their choice without fear of intimidation or confusion.

It has been well documented that many voters are confused by the present California candidate labels that are misleading. False or misleading campaign materials are not allowed, neither should our Secretary of State be allowed to mislead California voters, unintentionally or intentionally.

Please draft legislation before our California June 5th, 2018 Primary. Please correct our California election laws to accurately, correctly and honestly indicate in clear, concise and precise wording a candidate’s established political party affiliation or no political party affiliation such as Independents.

Candidates WITH membership, support or affiliation with an established political party should be accurately, correctly and honestly labeled. Candidates with an established political party should be accurately, correctly and honestly be stated as AMERICAN INDEPENDENT PARTY, DEMOCRAT PARTY, REPUBLICAN PARTY, GREEN PARTY, LIBERTARIAN PARTY, etc.

Candidates with NO membership, support or affiliation with an established political party should be accurate, correctly and honestly stated. Therefore, candidates with NO established political party membership, support or affiliation should be accurately, correctly and honestly labeled simply as INDEPENDENT to avoid voter confusion or intimidation. 

In summary, our California Secretary of State should not have a candidate naming scheme that overwhelmingly benefits one political party (Democrat Party) over another political party (Republican, Green, Libertarian Party) or Independent candidate. We respectfully request our California Secretary of State to perform with due diligence before our California Primary on June 5th, 2018, the following corrections to our candidate naming labeling to avoid undue influence, prejudice and confusion for California voters:

We, concerned democratic citizens of democracy respectfully request our California Secretary of State to perform with deliberate and due diligence before our California Primary on June 5th, 2018, the following corrections to our candidate naming labeling to avoid undue influence, prejudice and confusion for California voters:

1. Candidates with NO AFFILIATION, MEMBERSHIP OR FINANCIAL SUPPORT from an established political party, also known as INDEPENDENT to be correctly labeled “Independent”.

2. Candidates with WITH A DEMOCRAT PARTY AFFILIATION, MEMBERSHIP OR FINANCIAL support to be correctly labeled as “Democrat Party” and not “Democratic”.

3. Candidates with WITH A REPUBLICAN PARTY AFFILIATION, MEMBERSHIP OR FINANCIAL support to be correctly labeled as “Republican Party”.

4. Candidates with WITH A GREEN PARTY AFFILIATION, MEMBERSHIP OR FINANCIAL support to be correctly labeled as “Green Party”.

5. Candidates with WITH A LIBERTARIAN PARTY AFFILIATION, MEMBERSHIP OR FINANCIAL support to be correctly labeled as “Libertarian Party”.

6.  Candidates with WITH AN AMERICAN INDEPENDENT PARTY AFFILIATION, MEMBERSHIP OR FINANCIAL support to be correctly labeled as “American Independent Party”.
