Currently, California criminal law provides protection for victims against an alleged assailant. In a criminal action in which the defendant is accused of multiple sexual offenses with multiple victims, these victims are allowed to testify in front of a jury. However, California civil law does not provide this protection for victims, it protects the alleged assailant's previous acts to be protected from the jury during trial.

In order to widen justice for victims and hold alleged assailants that have additional, separate alleged assaults against them, we must extend the criminal code to civil code.

Two and a half years ago, a woman took an overnight flight from San Francisco, CA to Minneapolis, MN. During transit, an individual allegedly sexually assaulted her. Since the alleged crime happened in the air, she is not protected by California criminal law code 1108. Due to the actions of the individual, she felt strongly compelled that she was not the only victim of her alleged assailant and decided to go public with her story.  Unfortunately, her fears were true. After her story was published, multiple victims over the span of multiple decades reached out to tell their experiences. Several of the alleged victims agreed to go under oath in a formal deposition. However, solely based on the fact the crime happened in air, the victims are not allowed to their story to a jury. The absence of this civil law protects alleged assailants with multiple accusers. As victims of assault, we are forced to provide personal information including but not limited to sharing our mental health records, our medical professionals being depositioned, undergo multiple medical evaluations, provide bank statements, text messages, phone call logs, our private home addresses (that are given to private investigators), asked to provide details of our sexual history in depositions, and face intimidation factors. Victims that have the courage to go up against their alleged assailant, who oftentimes hold more power and influence, must face insurmountable challenges to receive justice. They stand on trial for all their life’s actions in a “he said vs she said” manner with every detail of their life being presented to the jury. Victims should be given the protection of allowing other additional victims to stand before a jury to give their testimony.
