Stop California Parole Board & Governor Newsom from releasing heinous MURDERER of a young mother because they now consider someone nearly 25 years old at time of murdering a “Youthful Offender”

Marcos Ortiz (CDCR# J09801), who was nearly 25 years old at the time he brutally raped and murdered HIS AUNT, Evelia Juarez (barely over 5’ tall and 110lbs, and only 29years old, with a 4yo son), at her home in Oakland, CA, has been given a release date at his last parole hearing.  This is NOT a situation of the wrong person being convicted.  He admits to every aspect about the killing…but continues to lie about the rape before the murder, in spite of overwhelming evidence that he raped her too (again, he has admitted (ever so slowly over the last 8 years) to the murder…this is NOT a mistaken conviction).

This was NOT one of those accidentally pushed someone in an argument and they hit their head and died killings. This is NOT one of those “momentarily snapped” and shot someone murders.  This was a butchering, after a rape, of a member of his own family, where the victim could have died at least 3 different ways… when the murderer could have stopped before each method and left the home safely. But, he did not.  And he made sure she was not just injured, but dead.  And, then, he made sure again. And to be triple sure, made sure again. After viciously raping her, IN HIS OWN WORDS, he beat Evelia so badly with his fists that she was knocked nearly unconscious (Ortiz was nearly 70 pounds heavier, and a trained fighter who had sent an even larger fighter to the hospital with a broken jaw).  IN HIS OWN WORDS NOW (he lied about it at his trial), “She had to pay for what she said” “I am going to kill her”, (which is what is known as “premeditated” in a legal sense) so even though he most likely broke her neck from that beating, he decided that was not enough. IN HIS OWN WORDS, as she lay on the ground, unable to move, he took a hammer and bashed in her skull repeatedly, leaving two holes where her skull shattered into her brain.  IN HIS OWN WORDS, that was still not enough to be sure...so Ortiz took a knife, and as he straddled Evelia’s back, and yanked her head up by her pony tail, so he could look into her eyes as he did it (HIS OWN WORDS), he jammed the blade into her neck and ripped it across her throat, 2-1/2” deep and 5” across, cutting her voice box, and nearly severing her head. He then dragged her into the bathroom and dumped her body to bleed-out by the toilet, and then casually went to the store to go shopping. Later that day, he callously called his uncle and rode with him to the home to watch his uncle discover his own wife, and mother of his 4yo son, covered in ants, butchered on the bathroom floor.  The following day, Ortiz took a VHS video camera (this was before it was common to have a cell phone camera) and went to the home and filmed the entire murder site down to the tiniest detail.

Ortiz is very smart, and not only used that intelligence to create alibis and try to get innocent people to take his blame, before he was arrested months after the slaying, but he has been called a master manipulator by psychiatrists. He continues to lie to try to convince the parole board that he is OK to get out. Just last year in 2019 he was denied because the parole hearing was one where the victim’s family could attend and have influence in, and they deemed him still lying about major aspects of his crime, and lying about many aspects of his life before the crime.  In 2019 the Parole Board STILL considered him a significant danger to those outside of prison if he got out. They told him not to come back for 3 more years. So, he gets an appeal, and comes back the next year in 2020. The prison system in CA is trying to cut down on their population (which can be a positive thing IF the right prisoners are chosen), and he gets a break with Corona Virus restrictions meaning neither the victim’s family nor the commissioners can attend in person, which is a much better way to judge the prisoners than a Zoom-style internet meeting.  Even with this lucky break, and a generous earlier hearing than the 3 years he was supposed to wait, he did not do anything…not a single thing different in his “insight to his crime”, and he once again told the same lies in 2020 that the 2019 commissioners felt made him unsafe to release.   But, a new commissioner in 2020 felt that Ortiz just sitting in prison for a little over an extra year somehow now made him safe to release to society.  So, why did he get a release date?  He manipulated the commissioners by crying at exactly the point he was chastised for not crying at in 2019 (or the previous 27 years either), and they thought that was great. This ONE commissioner fell for it.  He said, “why, why, why are you having that, that moment, uh, sir?  And then you’re showing some emotion.  What, what’s going on?”  Wow, check that box…and the commissioner noticed too!!!  Of course, it would be nice if that was sincere, and I am sure that happens in SOME cases…but we are 28 years down the line, and he has never done that.  Last hearing in 2019 he is told he needs to do that…and, like magic, smart as he is…he delivered his rehearsed emotion RIGHT ON CUE in 2020.  We know it may seem like we are being cynical…but that is because IN THIS CASE it is exactly what happened…it was a practiced response to make sure to show he has made progress when he really has not…because, if he had really made progress, he would have had full insight about his crime…not 80% of his crime, and he would not still be lying about many other things.   

A remarkably similar situation came up in 2017 where another “youthful offender” named Timothy Chavira ( https://losangeles.cbslocal.com/2020/06/22/timothy-chavira-life-sentence-editha-de-leon/ ) who had beat and stabbed to death a relative, and who manipulated the parole system, and got sympathy for his (fake) injured leg,, was let out by the Parole Board (and approved by Gov. Brown).  That could almost exactly describe Marcos Ortiz’s situation. What happened after Chavira was released?  Just months after his release, not being able to handle the outside world, he murdered again, this time a woman named Editha Cruz de Leon, who was also a doctor. The authorities said his only motivation was anger and hate. Any one of you reading this could be the victim of Marcos Ortiz if he is let out again by the same Parole Board that made this horrible error that cost a woman her life.

And, to make it much worse, when the prisoner was convicted in 1993, he was given a 16 years-to-life sentence because IN ADDITION TO TELLING A COMPLETELY DIFFERENT STORY THEN (aka “lie) THAN HE TELLS NOW, at that time prosecutors knew anyone with a “to-life” conviction was not getting out. Had they known then, what they know now, they would have skipped trying to protect the family from the more gruesome details they didn’t feel necessary at the time, and have nailed him for everything.  But, now, guidelines have changes a LOT in California, after giving those convicted of crimes “youthful offender” status if they were under 23 (instead of 18), in 2018 CA changed that to anyone who committed a crime who was under 26 at the time. So, this butcher, who was nearly 25 when he slaughtered his Aunt, is given a break as a “youthful offender”.  Even worse, the Commissioner at the last hearing, who completely missed Ortiz lack of progress on his insight from the last hearing, and completely overlooked Ortiz’ continued lying about key details of his life…made a critical error in mistaking Ortiz as 22 at the time of the crime instead of 25…and if you are giving benefit of calling someone a “youth” even at 25, to incorrectly take off 3 years of their age at the time of the crime is unacceptable.  After announcing the decision to give Ortiz a release date, the Commissioner apologized to the victim’s family, stating that his “hands are tied by these new laws”.  NO THEY ARE NOT. The Parole Review Board does not need to confirm a release date.  And, Governor Newsom has broad powers to overturn that decision and keep Marcos Ortiz in prison where he belongs, and where he won’t harm any innocent people again.

We have sent all of this information to the Parole Board Review Board AND Governor Newsom, but we need your help to let them know that this is unacceptable, and we cannot let butchers like Ortiz, who committed one of the most gruesome murders in Alameda County in the last 30 years (according to the Alameda County DA), and who still lies about all he did, and got undeserved breaks in errors in his favor by the commissioners, to get out.  Please sign this petition to tell the Parole Review Board and Gov. Newsom, “NO, this is not a person who deserves to be let out at all…especially when they have made mistakes in how they judged his risk to those of us on the outside”.

Please sign our petition to keep Marcos Ortiz in Prison until he AT LEAST fully acknowledges what he did, and he stops lying, because if he can’t do that, he can’t be ready to get out, and represents a significant danger to society.  We want to make sure the Parole Board and Governor do not repeat the mistakes it has made before.  And, with this petition, they will know if Ortiz does get out and harm someone, that they can NOT say they were not warned about that ahead of time.
