My Story: In 2009, when I was 23 years old (I am now 32), I had no idea that the next few years would change my life forever. After getting out of a serious relationship in early 2009, I started dating again. As luck would have it, I was introduced to someone through a friend and was told we would be a perfect match. I met him for the first time, and we instantly clicked. We never officially dated, but were "on and off" for a few years. Over the course of those years, he would disappear for a period of time and then resurface. I found it a little strange, but I went along with it. What I didn't know at the time, was he had some major underlying issues that were just about ready to surface.
In June 2012, he "resurfaced" again after not talking for a few months, and we agreed to get together. He had just moved into his own place and wanted to show it to me. I was so excited to go down there and spend time with him and see his new home. During the course of that night, he started telling me things that were very alarming and disturbing. He began to tell me that his family was incestuous, and that it was "ok". He then proceeded to take me into his bedroom where he showed me some videos of what he claimed was himself when he was little. Scarred, scared, and traumatized, I swallowed my pride and just sat and listened to him. I left the next morning, not knowing that this still wasn't over.
Two days later, I woke up in my house and looked at my phone, and noticed he had texted me over 40 messages. Confused, I opened them up, and found that my phone was now FULL of child pornography. He had sent over 100 images, and described each one, telling me that they were his family members.
It was at that moment that I knew I had a moral obligation to turn this in. It took me about a week to get myself together, to have to once again swallow my pride, and go down to the prosecutors office to report it.
My phone was seized as evidence, and within a week he was arrested. Upon being interviewed by the detectives, they found out that all the stories about his family were lies. He simply had an addiction to child pornography and had an interest in being around children. But, even with that, he bailed out the same day and walked the streets for 3 full years as a free bird before he was even indicted. Once he was finally indicted, the court process took about 6 months or so. I made sure I was at every court appearance and made sure he knew I was there. He finally took a plea deal and was sentenced in March 2016. He was sentenced to 3 years in state prison. 9 months later, in December 2016, he was let out of prison on parole. As with any sex offender/child predator, he was automatically mandated to register as a Megan's Law offender. But because he was deemed a "Tier 1" (there are 3 levels of tiers; 1 being the least threat and 3 being the biggest threat), he is not public record. Here's the best part, most Tier 1 Megan's Law offenders are NOT public record or public knowledge.
So because he never physically touched a child (even though he said he had and wanted to), he's not listed as public record.
My Mission: I truly feel that any person who is a child predator, child porn addict, or actually did hurt a child, should be on public record.
In order for that to happen, we are pushing to have the risk assessment that is used to tier these offenders when they come out, be rewritten to a more suitable version that is geared towards Internet crime defendants. The current assessment is geared toward physical crime again anyone of any age. By having the updated assessment written, these sex offenders charged with internet crime related to children will now be tiered correctly.
