Belly Mujinga was assaulted whilst carrying out her job at Victoria Station on March 21 2020. A man spat on her whilst claiming he had the deadly corona-virus. Inquiries were made and nothing was done. No arrests made. Days after the assault Belly was taken to hospital, where she was put on a ventilator. Sadly, Belly passed away on the 5th April 2020, leaving her husband and an 11 year old daughter. 

The police then issued a statement claiming the man who spat on Belly Mujinga had a negative antibody test in the time after the incident.

Despite the fact the man lied about having the virus, he should still be charged for assault under s.39 of the Criminal Justice Act 1988. This sets out the offence of Assault, something which the man who spat on Belly Mujinga carried out.

Assault, as distinct from battery, can be committed by an act indicating an intention to use unlawful violence against the person of another – for example, an aimed punch that fails to connect. In Misalati [2017] EWCA 2226 the appellant spat towards the complainant. The appeal court confirmed that although there was no actual violence, spitting is an assault whether it makes contact with the victim or causes fear of immediate unlawful physical contact. - Crown Prosecution Services, available on their website in further detail.

The CPS, the people we trust to prosecute criminals, have defined assault yet failed to act. Belly Mujinga was assaulted as defined by the CPS itself, yet no one has been arrested? No one has been charged? No justice has been served.
