Protect Birmingham parks and open space from illegal camping

We call upon Birmingham City Council and West Midlands Police to work together to use the powers provided under Sections 61 and 62 of the Criminal Justice and Public Order Act 1994 to protect public parks and open spaces in the city from illegal encampments.

Illegal encampments on public parks and other open spaces deprive the fixed residents of the city the right to use those parks and spaces for recreational purposes. Encampments are often associated with fly tipping which is unhealthy, unsightly and costly to remove; campers routinely defecate on the open ground where children may be playing; direct damage and fires are not uncommon. The encampments can be intimidating deterring regular use of the park. In recent months there have been illegal encampments across the city with many parks and open spaces being affected by more than one encampment.

Home Office guidance recommends the swift removal of illegal camps in order to reduce their associated problems and to avoid conflict between the fixed residents and the campers. The law provides two mechanisms by which speedy evictions can be undertaken. We call on West Midlands Police, aided by Birmingham City Council to use the laws available to effect swift evictions of illegal campers from parks and open spaces across the city.
