A developer just south of Nanaimo, BC is planning on filling in a small picturesque bay, part of Boat Harbour, in order to create a parking lot to serve a new private marina. This proposal would obliterate a portion of natural shore, destroy some inter-tidal and submerged marine habitat, and further degrade a natural rural coastal area. This seems so unnecessary as there is existing land available, much of it owned by the same developer. The developer is emboldened by his ownership of a 'private water lot' granted by the Crown to facilitate the export of coal which hasn't happened at this location for over 100 years. The granting of this water lot did not however extinguish all of the rights of the public and other landowners to access navigable waters. The creation of a fenced and gated parking lot on the foreshore would restrict or even deny public access in this area. To do this the Regional District of Nanaimo and the Ministry of Transportation and Infrastructure would have to approve of the final proposal. As well the Ministry of the Environment and our Federal Department of Fisheries and Oceans would have to have no objection.

The existence of Private Water Lots on our coast is an unfortunate leftover and does not support contemporary belief that our natural coastline is a cherished public resource. Our government bodies that normally manage development seem to struggle to determine their jurisdiction over these vulnerable and valuable resources. I believe the provincial Minister of the Environment should review our rights with respect to these properties, in particular the potential for reversion to the public under existing legislation or even new legislation.  Meanwhile there should be a moratorium on the dredging and infilling of these lots.
