We are advocating for all 50 states to have uniform hate crime (AKA bias crime) laws with mandated reporting to the federal government for better record-keeping in an effort to track trends and target areas with many cases of bias incidents.
As a bit of background, federal legislation currently allows states to request assistance for bias crime investigations but there is no mandated reporting, so some areas have reports of zero incidents. Five states have no specific bias crime laws at all. If problems cannot be empirically presented, it is unlikely to attract much attention, which is why we are proposing uniform laws and mandated reporting.
The FBI has defined a hate crime as a “criminal offense against a person or property motivated in whole or in part by an offender’s bias against a race, religion, disability, sexual orientation, ethnicity, gender, or gender identity.” Hate itself is not a crime—and the FBI is mindful of protecting freedom of speech and other civil liberties.
