TD Canada Trust Refuses to pay Critical Illness Insurance Policy

In July of 2015 we bought our first home and signed our mortgage with TD Canada Trust. The financial services representative we dealt with sold us Life and Critical Illness insurance. We were told by the financial services representative that we would be covered for $300,000 should one of us die or become ill and unable to work. The financial services representative told us that although this coverage was expensive, it offered us peace of mind in the event something was to happen to of either of us.
We pay nearly $2000 per year for this coverage, and now that one of us has fallen critically ill with a life threatening condition, TD Canada Trust is refusing to pay out on this policy.
In August of 2018, my wife Bianca began noticing that she was having an excessive amount of random bruising and in September of 2018 she was diagnosed with Aplastic Anemia and Paroxysmal Nocturnal Hemoglobinuria.
The primary treatment for both of these diseases is the same as it is for Leukaemia in that Bianca will require chemotherapy, radiation and a bone marrow transplant. If she is able to get treatment and/or survives the possible complications of her treatment, she will be hospitalized in specialized care facilities exclusively for at least 3 months. She is at risk for Graft vs Host disease that can have fatal or severe life altering side effects. Her body could also reject the transplant all together.
If the treatment is a success, she will be immunocompromised. She could become extremely ill or even die from the most basic sickness. She will lose her hair and be put into menopause at the age of 29 years old. This treatment will virtually eliminate her chances of having any more children and she won’t even be able to see or hold her 15 month old son for weeks.
In addition, she will be unable to work for over a year and now because of complications of her illness, she is currently not healthy enough to undergo the needed transplant.
TD Canada Trust is now categorically refusing to pay out our Life and Critical Illness insurance policy that they sold to us and that we continue to pay for. Both Aplastic Anemia and Paroxysmal Nocturnal Hemoglobinuria are life threatening diseases that are terminal without treatment.
Although Aplastic Anemia acts similar to Leukaemia and the treatment is virtually the same, TD Canada Trust will not pay out on the policy because it is not a “Life Threatening Cancer” as per their definition. At no point did the financial services representative explain or go over details of the limitations of the policy. It was simply sold to us with the understanding that we were covered, should one of us die or fall ill.
Cancer is defined as “a disease involving abnormal cell growth with the potential to invade or spread to other parts of the body” and Paroxysmal Nocturnal Hemoglobinuria is abnormal red blood cells that are spreading throughout her body - yet TD Canada Trust still refuses to make good on the policy that they sold to our family.
We are not looking for a handout or charity. All we want is for TD Canada Trust to make good on the Policy - as it was explained and sold to us.
By signing this petition, you are asking that TD Canada Trust to honour and pay out on the policy as it was sold to the our family by the financial services representative. You are also asking the Canadian Government to institute stricter regulations on the sale of insurance. More specifically, legislation to hold insurance companies and those who sell insurance to a higher level of accountability when they misrepresent policies or sell insurance under false pretences.
