Shut down Perfect Plants Patients Group, an illegal marijuana dispensary

The Perfect Plants Patients Group is currently operating an illegal marijuana dispensary at 2840-B Sacramento St., in Berkeley.

*This dispensary is illegal.*
The dispensary is not licensed, as is required by law, and is operating within 400 feet of a public school. If the organization regards itself as a "collective," it is also violating the law, since it is operating in a commercial district instead of a residential district, and its claims of 3,800 members would make the business a primary operation, and not "incidental" to a residence.

Neighbors, Longfellow parents, and community members have seen an increase in littering, loitering, drug use by minors, and secondary drug dealing in the area surrounding the illegal business. This business is located in a less wealthy, higher minority, and increased crime area of Berkeley, and this illegal business is not improving the neighborhood.

Despite being notified of the illegal business in the fall of 2011, no action has been taken to ensure that the business is closed and remains closed. In late September of this year, the Zoning Board recommended that the illegal business be closed, but the business remains in operation.

We are requesting that the City Council move to immediately shut down the Perfect Plants Patients Group. It is illegal, it is a nuisance, and it is a threat to the well-being of the neighborhood, its families, and to children attending Longfellow Middle School.
