Basketball Goals in Baywood Oaks Community

In 2017 alone, basketball goal violations were the second most frequent violation in the Baywood Oaks Community alone. This is a waste of our HOA fees to argue the acceptance of a sporting structure. There is an overwhelming demand amongst our Baywood Oaks residents to change the current policy regarding basketball goals.
At the annual meeting on January 15, 2018, the HOA board said that this rule was listed in the HOA Deed, and would require a vote from 67% of all residents. However, after extensive research and speaking with Dee Lozano, our AVR Management contact, it was determined that the basketball goal violation is listed in the Architectural Guidelines and Exterior Maintenance Guidelines, and may be changed at any time that the Architectural Committee deems necessary, without a formal vote from residents. Even with this new information, Dee Lozano insisted that the HOA board has other projects, and that sine this guideline has been voted on twice in the last 22 years (the last one being 8 years ago), that this is not a priority, and the board will only review the request once a large number of residents request a change.
Even if you do not play basketball or have young children who do, please take into account your neighbors who support this change. Please join us in changing the current policy.
As residents & participating HOA members in the Baywood Oaks Community, we would like to formally request the revision of the Architectural Guidelines And Exterior Maintenance Guidelines of Baywood Oaks Community Association, Section VIII – 10. Basketball Goals & Hoops. Our proposed revisions are presented below.
"Basketball Goals & Hoops: Basketball goals are allowed to be pole mounted in the driveway of houses with detached garages. The goal must be behind the center line of the house. No goals may be mounted on the garage or house structure. Goals may be placed in rear (back) yards subject to setback and easement restriction. Portable basketball goals will not be allowed in the unfenced portion of the yard.
To the greatest extent possible, basketball goals, posts, backboards, nets and hoops will be colors that are not offensive to the landscaping of the neighborhood. Bright, florescent, colors (particularly nets) will not be allowed.
Patio homes present unique situation for basketball goals. Because of the limited land space and the garage located in the front of the home, there is usually no location except the back yard that would meet the above criteria. Therefore, basketball goals on most patio homes will only be permitted at the rear of the house."
"Basketball Goals & Hoops: Temporary and pole mounted basketball goals are allowed in the driveway of all homes. The goal must be behind the center line of the house for all homes with detached garages, and behind the center line of the driveway for all patio homes. No goals may be mounted on the garage or house structure. Goals may be placed in rear (back) yards subject to setback and easement restriction.
To the greatest extent possible, basketball goals, posts, backboards, nets and hoops will be colors that are not offensive to the landscaping of the neighborhood. Bright, florescent, colors (particularly nets) will not be allowed. Basketball goals located in driveways must be properly cared for and in decent condition. Rusting poles, or hoops with torn or missing nets will not be permitted."
