We, the undersigned, are in favor of changing Article 16.39 in our Aquabella Association Declaration.  

We are proposing a change to allow basketball hoops to be permissible in our personal driveways. 

At this current time to not be in violation of the Aquabella Declaration you must remove the basketball hoop after each use.  This is a difficult task being that almost all properly secured portable basketball systems have a 35-gallon base. Whether you choose to fill with water or sand, your complete portable basketball hoop system will be anywhere between 300-500 pounds if properly stabilized.  Basically this leaves all law abiding homeowners without the use of these basketball systems.  It is unsafe for a homeowner to remove a basketball hoop after each use due to its weight.

The adults of this community have been trying our best to create different venues to cohabitate and have comradery with our new neighbors.  But we need to provide this same opportunity to our children.  It has been a very difficult time for our children during these past two years due to Covid lockdowns.  There has been greater incidents of suicide in the younger ages.  The crime rate among children has increased as we have already witnessed first-hand in our community.  

Making basketball hoops allowable promotes a healthy living for our children and encourages a sense of community.  It helps them create new relationships and foster friendships. 

We call on the Board of Aquabella to bring to vote for a change to the following Article.

Current Article reads as follows:

16.39​ Sports Equipment: No recreational, playground or sports equipment shall be installed or placed within or about any portion of Aquabella without prior written consent of the Owner’s Neighborhood ACC, if any, and consent of the ACC.  No basketball backboards, skateboards ramps, or play structures will be permitted without written approval by the ACC.  Such approved equipment shall be located at the rear of the Home or on the inside portion of corner homes within the setback lines. Tree houses or platforms of a similar nature shall not be constructed on any part of a Home.  No basketball hoops shall be attached to a Home and any portable basketball hoops must be stored inside the Home.  No tennis courts are permitted within Lots.  

PROPOSED Article to change and read as follows:

16.39​ Sports Equipment: No recreational, playground or sports equipment shall be installed or placed within or about any portion of Aquabella without prior written consent of the Owner’s Neighborhood ACC, if any, and consent of the ACC with the EXCEPTION of portable basketball hoops.  No skateboards ramps, or any other play structures will be permitted without written approval by the ACC.  Such approved equipment shall be located at the rear of the Home or on the inside portion of corner homes within the setback lines.  Tree houses or platforms of a similar nature shall not be constructed on any part of a Home.  No tennis courts are permitted within Lots.  Basketball backboards/hoops SHALL NOT be attached/mounted to any outside part of the structure of Home.  Portable basketball hoops WILL BE PERMITTED within the following guidelines:

• Will not be stationed on sidewalks or   streets

• Will not impede passing of pedestrians and will not impede traffic

• Will be properly secured to meet safety guidelines by each manufacturer with the base being filled with either sand or water.  If property owner chooses not to fill the base, then sand bags will temporarily sit over the base.  If you choose to have the sandbags over the base then you will have to remove the portable basketball hoop after each use and store it away within the Home.
