We are calling for the apology or resignation of Selectman Barry Greenfield of Swampscott Massachusetts for his efforts to violate the fourth Amendment of the US Constitution.
As reported in Swampscott Patch and other news services on and around November 7, 2013, Mr. Greenfield advocated the use of police to enter homes of law-abiding citizens without probable cause or warrant for the purpose of determining if they were in compliance with Massachusetts regulations related to storage and other laws.
Clearly this proposal was not to be a suggested or voluntary one but one backed by force and violence of the state. It also seems clear, given the rampant growth of militarized police forces in Massachusetts and throughout America that Mr. Greenfield's plans would be implemented by the heavily armed military style police we often see today.
It also seems clear that the hope of the effort is to catch citizens who are in violation of some law and use that violation as pretext to imprison them and/ or seize their firearms.
The text of the Fourth Amendment reads:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
Mr. Greenfield's proposal is a clear violation of the Fourth Amendment and the Bill of Rights of the US Constitution. Ironically his efforts to violate the 4th Amendment are related to his zeal to violate the 2nd Amendment.
We the undersigned demand that Barry Greenfield either resign from office immediately or apologize for his statement and agree to follow the US Constitution and cease and desist all efforts to undermine the Bill of Rights.
